A good defensive attorney is going to use every known avenue to put into question the validity of the BAC test. Breathalyzer results get thrown out often. A blood test using a swab can be contaminated. If it goes to trial (which I doubt), every detail will be scrutinized.
While I know lsupride isn’t the most loved poster on the OT, his point that the most damning evidence are the two statements by the guys who saw her last is spot on. Their perception of her inebriation is all that’s required to determine that they should have known she was not capable of consent. Those words can’t be taken back.

I’ve been sticking to the affidavit since it was released. It’s our most accurate depiction of what took place, especially Carver’s statement when he obviously thought he did nothing wrong and willingly spoke candidly of the events as he remembered them. People have been speculating wildly in both directions. You have posters who wanted them arrested for kidnapping before a single detail was released.
