Makes no sense. "Brain Dead" is not subjective..... it is measurable. ALso, people don't wake up from massive strokes with no deficits and do "fine". Sorry, but this is just too weird for there not to be more to the story.....

Ehhh... it's not so cut and dry. There are ways, and it happens all the time. I know someone very well who is an organ recovery specialist for a very large hospital and docs end up making this call, in unofficial ways, more frequently than you'd think.

While that's true, the problem with prosecuting is he was right, his actions prevented the death of another human, and the level of force was proportionate to the threat. (Actually it was less because he only threatened to use the gun and the hospital attempted to use deadly force against his son.)

Yeah, not to argue over minutiae, but I have to second this. People with brain death don't come-to just "fine." Your body cuts off blood flow to the affected area(s) and said areas don't regrow or fix themselves. You end up really jacked up. Whether or not you want to come "back" from that is a debate for another thread, but suffice it to say that if this kid really had brain death he's not fine now.

Exact reason I am not and will never be on a organ donation list. You are a phone call away from being chopped up and delivered to the neediest patient. The more alive you are the better.

Yep. Your organs are commodities if you are on that list. I'm sure I'll get all sorts of "that's not true" replies, but trust me, I know how it is handled from one of the few people who do it for a living. You may want to read the fine print on those organ donor pledges, especially in Texas...
