I guess purely by the letter of the law you could have. I can't imagine APSO ever writing me up for that.

I've heard stories of people getting DUI on lawn mowers on private property, what I'm wondering is what probable cause would an officer have to stop and walk up to a car on private property? Assuming the guy isn't obviously drinking alcoholic beverage like a beer can or bottle or wine glass.

well damn. this is a gray area. we have a pool and lots of time we're out drinking by it and get stuff out of our vehicles all the time (sunglasses, etc) and many times i turn the key in the ignition to put windows down or up, etc. at the same time.
i guess the risk is pretty low but i'm not really at a point in my life where i'd want to get arrested for something this dumb.

If you're out the vehicle you're fine, but if your in it and keys in ignition they can definitely pop ya. They would hafta be pretty shitty though, but it happens

Yes. I worked with my roommates back in the day. We went to the jail to post bond on a guy that had made it home but passed out in his driveway and a Trooper noticed ( 4 hrs later)and arrested him. Keys still in the ignition.

I just knew a few its happened too
But unless the cop is having a really bad day its usually not an issue. I don't think its something they ride around looking for..

i get that. i have a friend who grew up dirt poor in a trailer in arkansas with an alcoholic dad. one morning he woke up and the entire trailer was vibrating.
goes outside and his dad passed out with the car still in drive and it was pushing up against the trailer.
he said he just reached in the open window, turned the key off and went back to bed.

People still put keys in ignitions? Are you driving a classic as your everyday car?

I had a friend in college get one while hooking up with a girl at a house party. Car was at the end of the driveway almost behind the house. You can definately get a dui on private property

Not arguing you can be arrested while sitting in your car on your property, but you still have to go in front of a judge.
I was under the impression that they had to prove the defendant had previously driven the vehicle intoxicated before stopping or parking the car or intended to drive the vehicle intoxicated.

What does the "D" stand for in DUI? If he did not drive to that location under the influence and never moved, how is a DWI? Just curious if that would stand up in court.
