No dude, just no. Technically a cop may have been able to arrest you, and maybe some District Attorney might even decide to press charges, but no jury would ever find you guilty if it got that far.

Lol, yeah after two years of dealing with this bullshite. Y'all act like he would get arrested and the very next morning be thrown in front of a jury. Sorry, but no. They'd milk every cent out if him before that.

you know you could have plead guilty and after 6 months to a year it would be off of your record, here in BR. only way it would be flagged is if you got another DUI. you dont even have to pay a lawyer for that, you just have to know what to do.

But he was drinking in his vehicle that was on. So in his case, the officer had every reason to. I was agreeing it would be thrown out, after he had to deal with all the other stuff.

My point was that the officer didn't even need that much evidence to arrest and charge him.

Only convictions show up on Motor Vehicle Record (driving record) reports...whether its DUI, speeding, or running a red light. No conviction, no record of the offense on your MVR report that the insurer sees.

So the only way an insurer should find about a DUI arrest that you never got convicted on is if you were arrested after an accident and the cop mentions you being arrested for being suspected of DUI in the police report for the accident.

So its OK for someone to get shitfaced at the casino and get in their car and drive, but as long as they don't make it out the garage or parking lot, then no DUI because private property, right?

Not sure if y'all have a physical control statute in Louisiana, but you could have been charged with being in the vehicle, with the keys, in the driver's seat if so.

well, you've obviously got your mind made up on this but insurance companies will find out about a DUI charge prior to the resolution of the case, there's a poster on the previous page that attested to this, I've done quite a bit of work with the EAP where I work, mainly trying to help prevent the EAP from trying to ruin peoples lives, DUI charges are fairly common, and I can assure you that the insurance company will know of the charge and it will have negative ramifications regardless of the outcome, if you are licensed by the federal government, they will also find out
