When you entered a frontier town in the west, you were legally required to leave your guns at the stables on the outskirts of town or drop them off with the sheriff, who would give you a token in exchange. The shootout at the OK Corral was technically law enforcement attempting to enforce the ban of no guns in Tombstone.

I would think so. Most people aren't comfortable with a possibly loaded weapon being used as a tool to inspire discussion RE: constitutional rights. Seems like only a matter of time before one of these guys gets shot by another armed citizen who considered himself to be in imminent danger.

A strange man wandering around with something that just appears to be a loaded weapon was recently gunned down when someone called it in to the police. He turned out to be just a kid with a toy weapon in that case so the danger wasn't as severe as believed but the "play stupid games, win stupid prizes" mantra seems more apt for these guys than just about any other case I can imagine.

If Texas allowed open carry of handguns there wouldn't be so many of these videos on YouTube.

I notice evidence of concealed guns all the time here in Louisiana. I see them all the time at events downtown. Almost always white males between the ages of 30 and 55. Should cops detain them just to make sure

If they are concealing a rifle and wearing a kilt I 100% agree with them being ID'ed.

I'm not reading this entire thread (not yet, at least), but for those saying "the police officer has to check out whether someone openly carrying a rifle -- legal in Texas -- is a felon."

Do police officers have the right to pull over every car they encounter to check to see whether the driver is licensed? Absolutely not. See Brown v. Texas for a clue.

My argument is separate from drivers license checkpoints, which are random and less far-reaching.

Irrelevant. This man was carrying a rifle. Openly carrying a rifle is legal in Texas, unless you are "disturbing the peace." That's the loophole... does scared 911 callers reach the threshold of "disturbing the peace"?
