Another problem is state courts have no authority over federal tax law.

A divorce decree is an agreement between two ex-spouses. The IRS hates both of them equally and won’t care what it says.

Short of just not enforcing what is doled out, she can’t waive child support if whatever arrangement you all settle on in court dictates that child support must be given. The money isn’t (legally speaking) for her.

Obviously if you’re doing this outside of court it’s different.

So basically, it comes down to me paying taxes on $2000 if I claim 1 and she claims 1. We did everything out of court.

I would ask for it. That 200k of real estate is only going up over time. She's fricking you now more than she did before.

What? Healthcare premiums should be deducted prior, so yeah, taxable income would be lower, but also claiming the kids is a refundable tax credit which reduces the your tax liability

If you have 50/50 custody, I'd suggest you claim one and she claim the other
