Correct, the Supreme Court already ruled on this. Louisiana had the death penalty for child rape up until that ruling, was around 25 years ago.
We had a gay liberal Supreme Court back then. With the adults in charge now I could see SCOTUS saying hell yeah kill child rapists.

Why? Multiple states have done this over the years and it always gets shot down by the feds. This is just political pandering.
I think SCOTUS rulings can and should be challenged from time to time. This is one of those instances.

frick off, alter.
These replies are always so pathetic. Sorry I don't have the requisite internet cred to post in this thread.

Addendum: Can't wait years to get what's coming either. Quick ending

You've been a member of TD for 7 years and have 100 posts. And you chose to post in this thread. Pretty fricking obvious alter

And this will end up back at SCOTUS. Without a progressive majority that shot it down in Kennedy v. Louisiana, citing "racial bias", because of course they did.
You are correct that both Coker and Kennedy were 5-4 with the liberals in the majority of both.
Wouldn't mind seeing it overturned. Alito, Thomas, and Roberts all dissented in Kennedy, so just need 2 out 3 the of the new ones to overturn it.
Think you actually talked me into thinking this holds up.

I have an extended family member in prison because his insane ex-wife concocted a story about him molesting their daughter. Once he was convicted and went to prison for the rest of his life, the daughter realized the reality of the situation, completely recanted all of her testimony and said it was all made up bullshite, but a judge still said no dice, rot in jail the rest of your life.
I think a death penalty for such crimes should only come with absolute irrefutable proof, like semen or video or something more than simply testimony.

How is that any different than murder cases on death row who were wrongfully convicted and/or provided false confessions.

You could've just started here instead of calling me a pedophile for stating and objective fact

It's an odd reaction to immediately call it unconstitutional.
How is correctly stating the status of the law today "odd"?

It was so much worse than that. He made her put on her Girl Scout uniform also. She was brutalized requiring multiple surgeries

They used the Vito Corleone defense
quote:
VITO CORLEONE: and you ask me to do murder for money.
BONASERA: I ask you for justice.
VITO CORLEONE: That is not justice; your daughter is still alive.
BONASERA: Then they can suffer then, as she suffers.
VITO CORLEONE: Prego.
(then, to Tom Hagen, after Bonasera leaves the room)
Ah, give this to ah, Clemenza. I want reliable people; people that aren't gonna be carried away. I mean, well we are not murders
