We had a gay liberal Supreme Court back then. With the adults in charge now I could see SCOTUS saying hell yeah kill child rapists.

I think SCOTUS rulings can and should be challenged from time to time. This is one of those instances.

You are correct that both Coker and Kennedy were 5-4 with the liberals in the majority of both.

Wouldn't mind seeing it overturned. Alito, Thomas, and Roberts all dissented in Kennedy, so just need 2 out 3 the of the new ones to overturn it.

I have an extended family member in prison because his insane ex-wife concocted a story about him molesting their daughter. Once he was convicted and went to prison for the rest of his life, the daughter realized the reality of the situation, completely recanted all of her testimony and said it was all made up bullshite, but a judge still said no dice, rot in jail the rest of your life.

I think a death penalty for such crimes should only come with absolute irrefutable proof, like semen or video or something more than simply testimony.

How is that any different than murder cases on death row who were wrongfully convicted and/or provided false confessions.
