It would be different if the church was private property of the individuals involved, but it is not. If this was in their home and not at the church, then there’s no crime.

IIRC a passerby called the cops. I suspect the church would rather have kept it on the DL.

That still doesn’t constitute breaking a law, IMO. Obviously he should be fired.

I think the story is that a passerby saw lights on in the church and looked through a window. I don't know how this church operates, some churches are open at all times, but I think most of them now are only open during certain times. If this church is open only during certain times, then if this was one of those times where it wasn't open, I wouldn't think it would be considered a "public" place at that time.
