Yeah, but that's illegal. I realize there is a way to do it but didn't think a legal way. I'm fairly certain you could get that cleared if you wanted to go through all the trouble

I called the loan company and they said I was on the hook and nothing could be done since we were married at the time but I could file criminal charges. He refinanced in his name only so I didn't.

Wait, what? I'm relatively sure that once they are notified of fraud they can't just say well sucks for you.

If you got a lady and you want her gone
But you ain't got the guts
She keeps naggin' at you night and day
Enough to drive ya nuts
Pick up the phone
Leave her alone
It's time you made a stand
For a fee
I'm happy to be
Your back door man

It is possible. My ex forged my signature and used my salary information to obtain a loan to buy a car while we were separated.

Bingo. They do this ALL the time. The Loan processor WANTS to give you the loan and if the wife is like "my husband is at work and told me just sign his name" , they will almost always allow it.

Online credit card applications take zero effort to do this.

The way it was described to me is that because we were not in a documented legal separation in their eyes we were still married when the debt incurred so it was marital debt and I was still responsible for half. Even though he committed fraud they would only do something if I pressed criminal charges, just telling them wasn't enough for them to be able to remove me from the debt or remove it from my credit report.

Maybe things have changed (this was 15 years ago) but I was shocked at how "sucks to be you" their attitude was and how easily the ex managed to use my info to obtain a $35,000 loan and I had zero idea it happened.

She forged your signature. To me as soon as she did that, it's documented fraud given the circumstances.

Cease and desist? Are you sure it isn't a TRO?

I've been in banking for 20 years and this makes absolutely no sense. If he is an joint owner of the acct the bank has no right to put a hold on it. Only the IRS, our court order can place a "hold" on a deposit account.

The joint account is marital property. You just go before the court and present a motion stating why freezing the account is necessary ("I think Husband will deplete the entire account on hookers and cocaine"). You'll then be granted a court order to freeze the account - typically for a specific amount of time.

FWIW, my friend lives in a different state. Not sure if this plays a part in it?

I was under the impression that banks were regulated at the federal level, so being in another state shouldn't change the rules on when a hold can be placed on someone's bank account or who has legal authority to do so.
