Sorry to hear Corko. Hope you get it resolved quickly. I know my sham of a DUI in BR was a complete bitch. 24 hours in gen pop at EBRPP; many trips from LC to BR over 3 years for court dates that kept getting pushed back; $4,000; finally had the charges dropped.

Because I didn't know it existed and thought it was bullshite if you smoked a joint legally on Saturday and got a DWI for it on Tuesday.

Construct an argument- sure. Understand and apply that argument in the face of counterarguments coming from the state? I think you're giving the justice system way too much credit if you expect that.
Anyway, what I fear is that we're not so much legalizing pot as we are constructing something resembling the alcohol DUI system around pot. And THC levels are even more prone to abuse than BAC is.

Hes been less than forthright. We learned about 8 pages in the cops found his script bottle and 10 pages in that he kept driving because he "didn't hear the sirens"

That's OP's claim. I never said OP was innocent. All I said was that the legality of the intoxicant does not matter for DUI.
Had OP given blood, there would have been some traces of Xanax and the DA would have used it as evidence. Had OP's lawyer shown up at the jail, he would have almost certainly have said, "if you took Xanax right before bed, don't give them your blood."

Happens more than you think
Happened to one of my best friends on a day when I was with him all day at the lake, god as my witness he didn’t drink a drop. Got pulled over about 9 pm, cop accused him of doing drugs, he hadn’t. Friend asks for breath test, cop refuses. Cop tries to take him to the hospital for a blood test, friend can’t do that bc he smoked weed a week or so before, friend goes to jail
Friend got found not guilty in a jury trial for a DUI of all things but not before he paid an attorney, spent a night in jail, paid bail, and missed work about a dozen times for court dates that got continued
There’s other ridiculous parts of this I’m not gonna bother with explaining right now such as them “losing” the dash cam footage, then getting it back but refusing to play it during court but I’ll just say it was one of the most absurd and depressing things I’ve seen

The motorist calling him in and declined blood sample don’t amount to shite in court. It’s not evidence of him being impaired and while I’m at it the motorist calling him in is hearsay, who knows if it’s actually the same vehicle/driver the caller saw
