If your healthcare company doesn't know, or hasn't informed the employees who need to know, what the laws are, then they won't be in business for long. However, the lawyers have pretty much made sure that it is illegal to give a physician so much as an ink pen, so probably the law says it's a kickback.

P.S. There are so many things wrong with the grammar in this question that it is probably a moot point to try to help with that.

No such thing. So your question is invalid.

If the dispute is related to grammar, you're going to lose.

....your gonna loose.

I am not an attorney, but I would not consider golfing or a meal to be a kickback as long as it is not unreasonably extravagant...your point really is to spend time to build a relationship and inform the physician. tangible gifts, trips, etc. would certainly be out of bounds as far as I am concerned.

Didn't they place insanely restrictive rules on this sort of behavior? Personally, I agree with you that's how it should be, but for some reason I remember the current rules in place as being completely asinine.

I'm not an attorney, but I do know that apostrophes don't make words plural.

Being in marketing for a Healthcare company there is an argument as what is considered a kickback for business.

Is taking a physician golfing(and paying for him/her) if business is discussed a kickback?

Did you give this MD a free drug pen during this round of golf? If so, you're fricked!"

you're paying, so of course

There are limits. 50 bucks for nurses or hospital staff I believe. MD's though get more leeway. Drug reps can still buy lunch for offices from what I recall.

99% of attorneys won't know shite about the nuances of the anti-kickback statutes and regulations. Take any advice on here with a huge grain of salt.

Your company seriously needs to do some continuing education or seminars if its employees in marketing don't have a clue.

If you do it weekly. Yes. Once? Lame.

and you play golf....you don't ever say "go golfing" unless you are taking about your husband playing golf.
