Business Law: A man walks into a barber shop...

Attention: OT Lawyers (Philadephia and otherwise)

A barber leases space from a building owner to conduct business. A patron of the barber walks in to get his hair cut. The building owner is also in the barbershop. The building owner says to the patron, "Please leave my building immediately".

Is the patron legally obligated to leave the building?

The contract does not have language regarding asking people to leave the building. Just wondering how many contracts out there have this language... I'm sure most do...

Probably not. The barber could probably sue the property owner for breach of lease agreement or tortious interference with contract or something like that. When the property owner leases the space to someone else the owner cedes some of his usual rights such as being able to decide who can or cannot enter the property.

Of course it doesn’t have the specific language but many contracts do have language that allow you to make logical inference. At any rate, if you infer the contract doesn’t have such language then the answer you are looking for isn’t as black and white as you think it is. Pay for a lawyer to go through the civil process and find out who is right and wrong.

If the bldg owner walked in with someone the biz owner didnt like, could the biz owner tell the bldg owners companion to leave his place of business??

Just wondering...

Btw - reasons for bldg owner to tell patron to leave?? Was he completely innocent? Gay/different race/etc? Humped the guys wife/daughter/aunt/sister/all of the above? Known to cause trouble in some way? Does the bldg owner have a restraining order against the patron?? Guy a pedo and theres a school across the street?? Not as cut/paste other than go to lease...
