Fittingly, the judge who made this ruling got a DWI 10 or so years ago.

In March 2001, Johnson was arrested for first-offense DWI, but a Baton Rouge City Court judge acquitted him later that year.
In May 2003, Johnson was cited for misdemeanor counts of hit-and-run, failure to maintain control of a motor vehicle and driving without proof of insurance. His court date was scheduled for July 1. A witness at the scene indicated Johnson smelled strongly of beer, but Johnson did not take a breath test to prove or disprove this claim.

Yeah, a rather dark shade of Teflon.

Two incidents over a decade ago?
Guy could be sober now and not even touch the bottle.
Sounds like he knows how to play the law, as he should.

im not sure what his history would have to do with being able to look and see that BRPD was breaking the rules.

Well, one of the posters that pointed it out is law enforcement. They don't like it when people skirt the law, only the law enforcement officials themselves are allowed to do that.

Like a traffic court judge speeding or a drug court judge that took some puffs in college. No way they can make a unbiased decision now.

Those checkpoints can suck if you dont comply, even though you're not constitutionally required to LINK

I don't think the BRPD cares if these court cases are thrown out. I heard a few say that just being arrested is more punishment than the conviction. Their mentality is you are put in jail, have to hire an attorney, miss multiple days of work and have your name in the paper. All that combined is several thousand dollars. Whats a misdemeanor conviction compared to the money you spen?? Heard these lame fricks saying this shite as I was being locked up. fricking pigs
Eta I was innocent

LOL Don Johnson. Arrested so drunk that he had both pissed and shite his pants. This is the man letting drunks off on a technicality. Imagine that.

I heard they were fighting this all the way to the State Supreme Court. Just wasting tax payer dollars. They don't give a damn.
We're all innocent.

I agree. He could have ruled on an entirely different issue.

If the cops were really worried about stopping drunk driving, the penalties would be jail time. There would be no "pay the court costs and we'll reduce the charge" pleas either.
Judges set the penalties, not the cops.

If you don't think the cops bare just as much responsibility for the DWI "collections" as the courts do, it is you sir who are ignorant.
Jesus Christ on a pogo stick this site never ceases to to fricking amaze me.

quote:I wonder what the reason is for this.
The law says a police supervisor must decide the time and location of a DWI checkpoint. However, that same supervisor cannot take part in conducting the checkpoint.

whose fault is it that the technicality exist? maybe if brpd could follow simple rules instead of knowingly pissing on them people wouldn't get off.
