I didn’t say during; I said before. Of course a second degree murder charge is plausible. A manslaughter charge is also plausible. Then you have the outside chance you catch a stray juror or two who say “frick that, some bitch hits me with a shovel and she gets what’s coming to her, even if it’s half an hour later” and votes to nullify.

The manslaughter plea guarantees the State a conviction and guarantees the defense that they get to avoid an LWOP sentence. This is the kind of fact pattern that screams for a manslaughter plea.
