Daughter of a family I know wrote something about a bomb on the girls bathroom wall Mandeville High School (this is 8-10 yrs ago). She was arrested, expelled, homeland security was brought in etc. I know the dad and he told me the investigation scope was incredible. She had some very strenuous probation terms and was never allowed near that school again, rightfully so. Point being, this is how this a-hole should have been handled as well.

Don't know all the details, but even all things being equal, those are different jurisdictions. I can find similarly disparate outcomes for otherwise similar cases by county, state, and federal jurisdictions all over the country.

The feds may not have been able to hold him if he had yet to begin to carry out his plan. The threat could have been step one or two.

My point is that the seriousness of the threat is a matter of the true intentions of the guy. We can go by what he's said or we can go by a judge's decision and make assumptions based on that decision which could include, as you think, limited physical evidence. Which is very likely. And I would agree. But I don't believe that means this is a clear cut case of someone making an empty threat. And that's it. Nothing else too it. While it may be more likely at this point, im not in his head and neither is anyone else. So I remain skeptical.

Law enforcement can at least temporarily hold suspects in nearly any stage of an identifiable plot if it's deemed credible.

That's all fair. But you'd be surprised how many deadly threats are communicated in this country every day--boyfriends against girlfriends, employees against employers, threats against the first family and other public figures and celebrities, (more rare) bomb threats phoned into schools and other public venues. Authorities have metrics to assess whether or not it's something credible (and, if credible, imminent) or if it's a prank or somebody saying crazy shite in a rage or just blowing off steam. They're right most of the time. When they're not, people die. It wouldn't make sense to give a 5 years to every single person who's ever said "I'm going to kill that bastard next time I see him." Obviously his threat was more elaborate, but I imagine they looked into his background, ran forensics on his computer, phone, social media accounts, and determined that he was either blowing off steam or looking for attention. I wonder if he's undergone a formal psychological evaluation yet.
