I think he'd have a better case asking for a menu and being discriminated against by some punk employee/manager since they offer them.
Speaking of this every McDonald's I've been to its ironic that they say on the speaker box in print they offer Braille menus.

he should also go for discrimination of the vehiculary impaired, as they didnt have a pedestrial "walk thru"

Interesting thought. Never considered this before. I assume the rules for the drive thru are in place for the safety of both the employees and the customer. Allowing blind individuals to walk into the drive thru at night seems to be like playing with fire.

He could've called a cab like every single other person who doesn't have access to a car and wants McDonald's drive thru

Correct.
This in no way disproportionately affects the disabled.
Only cars are allowed to go through the drive thru. It doesn't matter your reason for not having a car. And a McDonald's drive thru is in no way possible a right of any kind being infringed upon.

I'll allow it b/c I was always pissed at the McDonald's in College Station for refusing to serve me at the drive thru when I was on a bike.

This isn't even close to frivolous in my opinion. Suing because their drinks have too much ice is, but this is a legitimate concern.

I tried this in college. No where let's you order on foot at the DRIVE thru. It's a safety concern.

What would stop drunks for suing? Alcoholism is a disease rt? Well they can't access drive thru either if they are obeying the drinking and driving laws.

I would have figured he was suing because somebody took advantage of his condition and tricked him into eating McDonald's.

When I worked at Canes, I used to tell people who walked up to the drive-thru window to come into the store. It's dangerous as hell to just have a guy standing in the drive-thru lane. I almost got hit multiple times just sweeping it.
