HR timeline is pretty easy to follow on this. Hire employee A, and laid off employee B.

Yep...and OP says they have him doing the hiring and laying off. So his signature is the one on that timeline.

You don't think anyone from upper management will step up and throw themselves on the sword, do you?

Age discrimination, and if your go along you will/could be in as much trouble as the management that told you to hire someone under 35, if there is ever a suit filed.

Report it as a whistle blower. You will then be untouchable, for a year or two anyway. If they take any action against you after acting as a whistle blower you could be set up with a pretty solid retaliation claim.

Some companies frown on employees especially managers posting their private business on the Internet. If they wanted to replace you this is an easy violation of most companies policy's.

What company do you work for?

I'd like to know so that I'll avoid ever sending my resume there.

I would advise you to take all the information out of this thread that identifies you. Age, job skill, former place of employment, etc.

Too late.

Just committed to taking the insubordinate route. His exact words were "don't be a pussy" as I was walking out.

Whistle blowing in progress.

This.

Document everything and do not participate if they refuse to put their orders in writing. Cover your own butt!

Should have recorded this conversation. Louisiana is a one party consent state.

Sad to say, but as a semi old timer who has been around this block before, this is getting very very common. It's just that most companies now have decent HR departments that know better than to ever mention age in any hiring/firing situation. I've told both my sons, now entering the real world of working for a living, that all they owe their companies is a good job performance for wages earned. Beyond that, their families come first. Loyalty on the part of companies does not exist any more.

I am always amazed at what people post here.

The Internet hasn't been anonyonymous in about 20 years.

I am not your lawyer, nor do I practice in Louisiana.

But for your general knowledge, there are often exceptions to agreements containing NDAs and "participation in an EEOC or related proceeding or investigation" is frequently one. You might want to keep an eye out and see if yours has such an exception.

Is it possible that upper management has reasons you don't know about and they're not telling you?
