Are traffic attorneys worth it to contest a traffic ticket i got today?

I got cited for failure to yield today after a Tesla was in a right turn only lane and cut into my lane and I grazed the side of it. I got it on dashcam and even showed the officer but he said it was my "due care" responsibility to let him cut infront of me even though i had the right of way
I was cited under Florida F.S. 316.1925 which states
But I feel like the Tesla driver was wrong because Florida F.S. 316.085 which governs passing and lane changing says
Basically the Tesla driver realized he was in a right turn only lane and instead of just taking the L he decided to bully his way into my lane and try to squeeze infront of me and the car infront of me and failed. And the officer says it's my fault. Wonder if the fact im white and the officer and Tesla driver were Latino played a role here but I don't want these points on my record and my insurance rates to jack up. Is a traffic attorney worth it here?

quote:
Any person operating a vehicle upon the streets or highways within the state shall drive the same in a careful and prudent manner, having regard for the width, grade, curves, corners, traffic, and all other attendant circumstances, so as not to endanger the life, limb, or property of any person. Failure to drive in such manner shall constitute careless driving and a violation of this section.
But I feel like the Tesla driver was wrong because Florida F.S. 316.085 which governs passing and lane changing says
quote:
No vehicle shall be driven from a direct course in any lane on any highway until the driver has determined that the vehicle is not being approached or passed by any other vehicle in the lane or on the side to which the driver desires to move and that the move can be completely made with safety and without interfering with the safe operation of any vehicle approaching from the same direction.

My bet is the cop not having a clue what he’s talking about. Go for it.

Seems like a big expense for a $200 or so ticket...
Can't you just take a defensive driving course so it stays off your driving record?

Based on the thread title, I planned to say “probably not, but maybe if…”. Based on the OP, yes, hire an attorney, if for no other reason than this is likely to require multiple court appearances, and having your attorney appear will save you aggravation.

You sound like a black guy talking like this!

I'm betting the other driver thought you'd be an understanding considerate person and let him in, courtesy waves exchanged, and move on with your lives, but instead you are an a-hole who thinks you own the road.
And complaining about the Hispanic population in Florida is like complaining about.... nevermind.
The best case scenario is it gets considered dual fault, your insurance still goes up, but your insurance pays for your shite and his insurance pays for his shite. And you both pay fines.

Just go plead no contest, get adjudication withheld, get no points .

Not really, no. But attorneys who spend a ton of time at the courthouse anyway will frequently take traffic cases because they are usually easy for the attorney to resolve without taking much time out of their day.

Why don’t you defend yourself? Sounds like you got a handle on it and we’re not talking jail time here.

The exit i take to get home is a cluster frick due to a bridge construction. It usually takes waiting in the left lane for 10+ minutes every day to finally turn left at the light. So people try to cut the line by going thru the right turn only lane and trying to get over - i didn't let him over.
I figured someone else would. I definitely did not think he would risk a collision but he did.
Was i an arse yes but no one likes the line cutters.

In spririt I'm with you. But the letter of the law is with the other guy. If the front of his vehicle touches the side of your vehicle, it's his fault. If the front of your vehicle touches the side of his vehicle, it's your fault.

Even if there wasn't a full vehicle length of space between me and the car infront of me?
I feel like this sets a really bad insurance fraud precedent. Just violently swerve into the lane next to you and get some sucker to hit you.

The laws and statutes are written and created by legal minds and lawyers, argued and amended and their validity ruled by judges. Majority of cops are high school graduates who don’t have a clue into critical thinking and the law. They just go with whatever was easiest and they remember from their 6 week class while running around the city in grey sweatsuits. You will probably win. And then if the cop shows you can look at him and smile and give him a little wave to let him know he’s an idiot. You can’t put a price on that.

That precedent was set decades ago, baw.
