Basically. There have been very few in this thread who have suggested #9 though, and some of us, myself included, have questioned what steps, if any, could have been taken before it ended up in a physical altercation on the ground.

Him simply moving his hand toward that pocket is enough to justify the shoot.
If the vid shows him reaching for the pocket, this a textbook shoot. They handled it perfectly.
If he's not, those cops may in trouble

Well at least we know you aren't a lawyer.
FWIW, that is EXACTLY how it works in court. The Defense, assuming this goes to trial, says "he went for a gun" and the Prosecution (who bears the burden of proof) has to PROVE BEYOND A REASONABLE DOUBT that he wasn't doing that.
I mean, you couldn't be more wrong in your statement if you tried. Damn.

The location of the gun is a non-issue here.
You better learn to DOJ so they can cancel their investigation.

How does it work in court? The defendant is presumed to have unjustifiably murdered Alton Sterling?

I'm sorry but I fail to see the logic in tackling him at that point.
This was more my point. I don't think this is murder but I think the cops are grossly incompetent
Their lack of ability to handle their job got someone killed.

can somebody fill me in?
After watching the video and reading about this for 15 minutes or so, I have learned that:
(1)this guy was a felon
(2)who was carrying a firearm and
(3)was resisting arrest and
(4) the officers attempted to subdue him without lethal force and without even drawing their weapons
(5) and then one cop yells he has a gun
(6) and then the other cop draws and tells him not to move or he'll shoot
(7) and then the perp does or does not grab or reach for his gun
(8) and then the cop who didn't draw his weapon originally, who only drew the weapon after he heard the perp has a gun, who warned the perp not to move or he would shoot, fires two shots,
(9) and this is automatically racist murder
does that about sum it up?
Yep.
Murdered, nothing to see here.
More arrests than years the Cane's girl was alive. Felon in poss. of a firearm while resisiting arrest, then died due to his actions. Time to riot.

Oh, I get that. I'm talking about the national viewpoint, not the opinions of the bastion of humanity that is the OT

Yeah of course. I think there are valid questions that should be answered about the situation, but the protesters are 100% useless and don't give two shits about the truth one way or the other. They found their catalyst and they'll run with it.

You seem very uneducated.
Especially in regards to use of force situations and the law.

BTW, I don't know why everyone is all excited for DOJ to be investigating.
Y'all do realize that they have a HIGHER BURDEN of proof for a violation than a state agency?
They have to prove not only that they unjustifiably murdered this guy but that they did so solely because of his skin color. That just ain't going to happen. Not surprised that the DA was quick to give the case up.

There is no witness that said he went for his gun. The witness stated the cops pulled a gun from inside of his pocket after he was killed But you are correct. We will find out if and when the store security camera footage is released
Has there been any footage released showing him pointing a gun at someone which supposedly initiated the 911 call? I may be totally off on this one but I have a hunch someone called the cops on him because they had a beef and knew he was armed and would get arrested. He was probably trying to lose the gun not shoot the cops with it. Sucks being a felon.

And you show the film and ask the jurors.."and where does it look like he is actively reaching for his gun"?

I doubt the Triple S was so inclined to have CCTV.

Civil rights don't just apply to skin color. My and your civil rights can be violated if a cop unjustifiably shoots me or you and the shooting does not have to be about race.
