So she didn't make the conscious decision to follow them men to their car with no coercion on their part?
Just so we’re clear, you are referring to the car ride where she nearly immediately fell over to the side and was unable to answer to the driver her address? The same car ride that was offered to her because of her known drunkenness to which she repeatedly fell over and was helped picked up off the ground by the outside bench? I just want to make sure we are on the same page when talking about which car ride.

What evidence has been shown that she was willing?
I don't think the prosecution is even arguing force was used.

She didn’t “run across a parking lot”
This is also real low iq argument and ignoring all other known details of her drunkenness known by the rapers before that event and even after that event.
Whatever level of consent she gave or didn't give will be used in future rape cases.
So if a girl can walk across a parking lot and get in a car and there's not evidence of her denying consent, that's the standard others will use in cases going forward.
This thread is clear that the the dudes will not get any serious punishment. It wouldn't matter if the girl had sex with half of baton rouge, if she said no in that moment or was too inebriated to give consent then it's rape.
All these people saying they feel bad for the girls family bc people are saying she's fast or dirty.
Seriously, who cares?
young (legal) women are sexually active. Why would a family even care about it if that's what she wanted to do? Her sex life isn't something that matters one bit.
This is like some horrible insight into the weird Victorian mindset of men who think women should not sleep around.

we are all aware of all of that.
You are trying to definitively say b/c of that, nothing else matters and she was 100% too drunk to consent.
and guess what, most people would probably agree, but just b/c we agree on that in here, doesn't mean that's what will hold up in court. That's the part you can't seem to understand or differentiate from.

With the assistance of three dudes

Correct. 100% too drunk to consent. She was raped and then left off the side of a street unattended which directly led to her death.

Imagine everything is the same but it's you and your buddies. Maybe someone gets lucky that night.
The girl said she was raped. Would her being able to walk with assistance be important?

So what are they arguing?
3rd degree rape (via the intoxication)
1st degree rape (since more than 1 participated, although I'm not sure that's the correct use of the statute).
and that old lady's boy crush casen has a video voyeurism charge

Are you implying these guys took advantage and had sex with an unconscious drunk girl that willing followed and got into the car with 4 drunk guys, and shes on video asking for sex......are you saying that's rape and not just causal sex?

I'm not saying anything. I told you what the prosecution was arguing.

and that's why i've said you can't just claim rape 100% of the time just b/c the woman is drunk. That's not me saying no woman is ever raped. That's me simply saying drunk women have consensual sex all the time.
There's no denying she was really drunk, but that doesn't mean she didn't want to have sex with them (and i'm not saying she did or didn't here), and we can't ask her anythign about that night anymore unfortunately.
If we are trying to pinpoint a certain BAC to say that's the point you can no longer consent, i don't think that's something that works, b/c like i said, drunk women have consensual sex all the time. There's nothing concrete that says how drunk is too drunk to consent. The answer is pretty much if she's passed out and is non verbal, she's too drunk.

Meanwhile this is one of the rapers being defended on this board. Multiple rape allegations, one after another.

It’s a term literally used in the article. I’m sure you are wanting to talk about anything but the raper himself.
