I don't believe there was a trial by jury. From what I can tell the defendant had it dismissed prior to trial by claiming qualified immunity.

The case went before a Grand jury and he was aquitted...the civil case was filed in december

Because no one has to argue if there was an actual danger, just if the officer felt there was one.

He could have imagined the driver was a pink monster that was going to eat him, and if the court though it was true that he thought that, then he walks.

No but when the victim lost his appeal they ordered him to pay over $15,000 in court costs.

I still can't get over how they ordered the victim to pay $15 grand in court coats when he lost appeal. Stay out of Alabama y'all!!!

Which is a joke because the DA is the only side presenting whatever evidence he wants to. He could have witheld the videotape and no one would have known. He's not obligated to present all evidence, just what he wants to.

A lot of times they bring on very friendly faces to compel the GJ to no bill a case... Friends, families, wives who are scared for their husbands not coming home, also fellow officers saying he was a stand up officer make it difficult to indict.

Also, it's the perfect way to bury a case because GJ transcripts are secret and sealed.

And I am guessing after getting the case dismissed, it was appealed to the CoA, where it lost again.
