Airline faces Criminal Charges for noise violations in California

An airline is facing criminal charges for allegedly violating the Long Beach Airport’s noise ordinance on 16 separate occasions in the past year, according to a criminal complaint filed by the city prosecutor’s office this week. The complaint — filed against Mesa Airlines and American Eagle on Wednesday, Aug. 14 — alleges that the airline violated the city’s ordinance on noise curfews 16 times from August 2018 to July of this year. This is the fifth time the city has prosecuted an airline for violating the noise ordinance since 2002, City Prosecutor Doug Haubert said Friday.

The airline allegedly violated the city’s single event noise exposure level, which sets decibel limits for various times of the day. For example, during the day, arriving aircraft must generate no more than 101.5 decibels of noise. But from 6 to 7 a.m., and between 10 and 11 p.m., the decibel restriction drops to about 90. Overnight, from 11 p.m. to 6 a.m., that’s lowered to 79 decibels. American Eagle, as written in the criminal complaint, allegedly exceeded the overnight noise exposure level 16 times; each of which is a misdemeanor count as laid out in the criminal complaint. And those decibel violations range from 87.7 to 92.5.

Are they going to fine the plane?

Next the residents on Long Beach will complain about limited flights and blame Republicans for this.

Sounds like an easy way for the city to collect revenue. What is the plane going to do, throttle the engine and crash?

Maybe.

No criminal case is prosecuted unless all reasonable efforts have been exhausted before filing a criminal case.”

you'd be surprised what you have to do in the cockpit to avoid these stupid things.
this is from a while back, but the stupid restrictions havent changed.
ppl who build next to an airport then complain about airplane noise can kick rocks
to comply with the requirements, they must violate the basic tenets of their flight training with an array of techniques that includes power cutbacks at low altitude, abrupt maneuvers and the use of minimum power to tiptoe over neighborhoods adjacent to the airfield.

So... if the plane is in the air but running a little late, should they land in Long Beach and take the hit for noise violation or should they divert to another airport entirely at the last second and inconvenience the passengers, flight crew, airlines, airports, and everyone else other than Long Beach?

They divert to Los Angeles and bus the passengers in most of the time.

SNA has similar restrictions. If your flight is scheduled to leave at 7A, you sit on the runway til it’s legal to leave, even if ready to take off early. I’ve also been on a flight that was late arriving and was diverted to LAX because of the noise curfew.

Burbank has similar curfews. Basically, Burbank and Long Beach are airports in the middle of residential areas.

I hate California.
If I was a rich guy I’d buy a L-39 and do a few flat passes at full power.

You would think that the airlines would have an extra fee for this.
We have planes fly over our neighborhood all the time. To be honest I considered that a perk when we purchased the house because the kids and I enjoy sitting in the back yard watching the planes fly over. Granted we are far enough out not to be bothered by the noise but close enough to identify most of the aircraft aircraft on approach.

No way.
That'll get them another noise violation.

I would buy a house on the approach and departure ends of a runway just for that reason. A modern airliner is not that damn loud. These people should let an MD-88 come over

Remind me to keep not going to California.
