I know you can sue for anything… but the chances of being successful in a suit where they are driving an off-road vehicle, on the road, unregistered, when the law requires you to register an on road vehicle, with tires not designed for pavement, on the pavement, and the law that would require a helmet, and they are not wearing a helmet?
