The Who Dat Nation just needs to flood the market with Who Dat stuff!!! There has to be some lawyers in the Who Dat Nation that can advise and/or handle this crap for the store owners

Well if that's the case then the Catholic Church should get a portion of the NFL profit from people selling Fleur- de-lis and "Saints" items. After all it is their domain.

These are the same phaggots who made the "we be Saints" shirts! So weak.

More reasons to hate the NFL.
I love the Saints, and I love football, but the NFL is becoming more and more a joke. Saints shirts like this have been around forever with the league doing nothing about it, now that the saints are winning the league begins to care about stuff like this.
Also copywriting catch phrases is such a load. I'm done.
I'd honestly prefer to watch HS football and then have college on Saturday and Sunday.

Is bs. I especially got a kick out of the NFL owning the Saints colors. So does the NFL own the Texans red, white and blue. Perhaps the US should come down hard on Houston for their colors. Or Perhaps the state of Texas should put out their hand for the Cowboys using the state's star.

Wikipedia - Origins of "Who Dat"
Reliable sources say the NFL is sending a Cease-and-Desist to the Vatican.

So, does the NFL also own "America's Team" ? Or "Who Dey"? Or "Lambeau Leap"? Or any of the hundreds of other terms used to refer to teams or cheers associated with NFL teams?
Great idea ! In one of the worst economic times the country has seen, let's take another slice of the small business pie !

Yeah pretty much. At least when you're attempting to make a profit off of it. If its something that reminds the consumer of an NFL team, they own the rights to it. If the Who Dat shirts were mardi gras colors, it would probably be ok.

Why can't people understand the NFL is a business? They are trying to make money. If they allowed everyone to use their trademarks for profit they would lose vast amounts of income.
As for fleur-de-les, colors, and phrases, it is when used together in some fashion. If you look at the shirt in the picture it is black and gold, has a fleur-de-les, and says who dat...clearly a Saints shirt and copyright infringement. And the saints did not copy write all fleur-de-les just the one they use in the logo. Otherwise I’m pretty sure the French have the copy rights on it since they have been using it for some 500 years.
It business most corporations and business trademark their logos and colors. I mean even the Hell’s Angels copy righted the deaths head logo. Why should someone profit from an organizations success without giving that organization their credit or share of the earnings.

I'm not a lawyer, but I still understand the principles behind copyright law, unlike most people who are whining about this...

I think I'm going to buy the rights to the phrase "What time is it?" I'll collect royalties on everybody.

Funny that the NFL didn't give a rats arse about "Who Dat" until now.

Depend on how you look at it. The NFL's gestapo could be bluffing. They tell the store owners to "cease and desist." The store owners could meekly comply, or, tell the NFL to stick it ... sue me. Yes, the NFL could call the bluff and actually file suit... a stupid PR move, but ... they could do it. The store owners need to seek legal advice and obtain a risk assessment - if they continue to sell the shirts, how likely (or not) are they to lose a lawsuit?

Funny that people weren't profiting from it until now, as well.

The store got permission to sell the remainder of their stock of that particular shirt. So, really she didn't lose, she just can't continue to make a profit without the NFL's permission. Which, she could get if she asked and paid the NFL their royalties. She tried to bet the system by adding the # sign, it didn't work. She did get parody with who D@ though.
I hate when people bitch about the big guy pushing around the little guy! If they let every little guy have their way they would go broke.

Would these tshirt vendors even be selling a Who Dat shirt if the NFL and Saints hadn't created the demand for them? Why shouldn't they get their cut for creating the market?
If you want to be mad at the NFL for something, at least have a good reason. It looks like the NFL lawyers may just be in shake down mode and not have an actual claim to Who Dat. A money board poster said some guy from New York holds the trademark.
