He's not suing because they didn't hire him. He's suing because they didn't seriously consider him and the interview process was a sham. The Saints had him for an interview that took place over two days. Clearly the Saints were serious, so no threat of being added to the lawsuit. All anyone is asking for is serious consideration.

A team hiring a white coach has no less merit in Flores’ case than if they would have hired a black coach. The law states the they can hire who they want as long as they do not discriminate. He has to prove it outright. Just by saying oh look this team didn’t hire a black coach can be countered with well this team did.
He’s not gonna win. He’s gonna be the coaching version of Krapernick
