The article of who he is...

New Orleans Saints Coach Sean Payton said his National Football League team had a special operative who helped win the Super Bowl: sports agent Mike Ornstein.

Payton said Ornstein helped arrange logistics such as game tickets and travel for players’ in-laws, minimizing crises. He also dreamed up irritations for the Saints’ opponent, the Indianapolis Colts, including strategically placing the Saints’ fleur-de-lis symbol around the Miami area.

“There is a little bit of a propaganda battle to how we travel -- the hotels we’re staying in, what the wives are getting, the flowers, the cameras, the billboards -- and that’s one thing we felt like we needed to win prior to even playing the game,” Payton said in an interview today. “By the end of the week, the scene was the fleur-de-lis everywhere.”

PFT-

Mike Ornstein, a former league employee turned marketing agent, has pleaded guilty to federal charges related in part to the re-sale of Super Bowl tickets, according to Liz Mullen of SportsBusiness Daily.

According to Mullen, Ornstein allegedly conspired to sell tickets that had been purchased "from people who, through the course of their employment, had obtained the tickets at face value." He also was charged with "selling pieces of NFL jerseys which were falsely represented as being worn by NFL players in games."

The counts in the federal case included mail fraud, wire fraud, interstate transportation of stolen property, and money laundering.

Mullen reports that the plea deal was struck in June 2010, and that Ornstein is awaiting sentencing.

Ornstein has represented Saints running back Reggie Bush, and Yahoo! Sports previously has reported that Ornstein allegedly gave money and other benefits to Bush while he still was playing college football at USC. As Dan Wetzel of Yahoo! Sports points out via Twitter, former USC coach Pete Carroll arranged an internship for Bush with Ornstein.

It's the second time that Ornstein has been convicted on federal charges. After the first incident, he continued to enjoy a close relationship with many key league figures. Those relationships could be seriously tested if Ornstein's plea deal includes providing information regarding the manner in which the tickets were obtained from people who had obtained Super Bowl tickets through the course of their employment at face value, or regarding any other information that Ornstein may have that could harm the interests of the league.

In many cases, the folks who have access to Super Bowl tickets at face value through their employment are folks are employed by the NFL or one of the 32 member franchises.

That was a really cool article about Ornstein painting Miami black and gold.

Did not know that - those are the types of stories I most enjoy.

So the main charge against him is essentially scalping? The Feds have way too much time on their hands.

The most interesting part of the story to me is that Pete Carroll sent Reggie Bush to 'intern' with a convicted felon.

Before getting into the legal nitty-gritties, we'll share a text message received from a high-level source with one of the NFL's 32 teams: "You better believe there are people sh-itting their pants with this Ornstein thing."

And perhaps they should be. Ornstein's guilty plea involves in part obtaining tickets that had been originally purchased at face value for an amount above face value. Chances are that at least some of the folks involved who purchased tickets at face value and sold them to Ornstein got the tickets via their employment with the NFL or one of the teams.

As part of the plea, Ornstein agreed to forfeit $350,000 to the United States government. That amount presumably reflects the total revenue generated from the fraudulent activities. Most of it obviously came from re-selling Super Bowl tickets.

At the time of the entry of his plea, Ornstein cut a check for $110,000. He still owed, as of June 7, 2010, $240,000.

Orstein was due to be sentenced on August 30, 2010. We don't presently know why he hasn't been.

We also don't know how deep the rabbit hole goes, or whether the feds are trying to find out. NFL spokesman Greg Aiello tells Mullen,

I don't understand why this is a federal problem. Scalping is handled at the state and local level isn't it?

quote:

In the United States, ticket resale on the premises of the event (including adjacent parking lots that are officially part of the facility) may be prohibited by law, although these laws vary from state to state and the majority of U.S. states do not have laws in place to limit the value placed on the resale amount of event tickets or where and how these tickets should be sold. Ticket resellers may conduct business on nearby sidewalks, or advertise through newspaper ads or ticket brokers. Some U.S. states and venues encourage a designated area for resellers to stand in, on, or near the premises, while other states and venues prohibit ticket resale altogether. Resale laws, policies and practices are generally decided, practiced and governed at the local or even venue level in the U.S. and such laws and or interpretations are not currently generalized at a national level.

If the transaction crosses state lines, then it's a federal issue.

Not just the tickets crossed state lines.
quote:

The conspiracy also consisted of fraudulently advertising NFL jerseys as game-worn. Among other things, Ornstein caused false certificates of authenticity to be faxed from California to New York. Ornstein and others thereafter sold approximately 20 jerseys for a total price of $30,942.24, with a profit of $26,300.91.

The charges cover 1998-2006, which predates his involvement with the Saints. What teams are quaking in their boots? The Ravens?

U sure of that? That predates his involvment with the Saints regarding Bush, but Ornstein reps a good # of players.

More teams than just the 2 participants get tickets to the Super Bowl. In fact if anything it would seem more likely a team not in the Super Bowl would bee willing to sell their tickets to Ornstein than guys whose team are going
