While that's great, I still don't see the courts allowing Benson to take away an irrevocable trust. I mean you set it up that way, it's irrevocable for a reason.

Yeah but those weren't controlling shares. So that has nothing to do with Benson firing their asses from the Saints and Pelicans.

Value for value is allowed, as I recall, even with "irrevocable trusts".

My dad is one of the top trust advisors in the country, and he told me there are a few ways to set it up where that would be acceptable. He found our threads on this subject very laughable way back when.
Also, it was reported that no controlling shares where contained in that trust, so Benson protected himself there

I believe Benson created an imperfect (or intentionally defective) irrevocable trust, which does allow for substitution of assets.
The problem is that Benson doesn't have other assets equal to the value of the Saints (or Pelicans) to make a proper substitution.
It's all going to come down to the "bean counters" and their valuation of Benson's assets that are outside the trust.
ETA: AS others have said, it's now just a money issue. the beneficiaries of the trust are entitled to cash payments as stipulated in the trust, but they will not have any management say so. I bet that Gayle will make sure the operating expenses of the Pelicans and Saints will eat up most, if not all, of the profits before any payments are made the beneficiaries!
