Although Ruffin says that Smith "had a gun," police have pointed out that he didn't have the gun in hand -- it was in his car. Authorities also found a gun in Hayes' vehicle, which was in addition to the gun that Hayes allegedly used to shoot Smith.

Fact?

quote:

An attorney for Will Smith’s family says that Cardell Hayes fired two shots into Racquel Smith’s legs before opening up and firing repeated shots into Smith’s back and then standing over him shouting as he lay dying.

We'll need to see if this is a fact.

quote:

New Orleans Coroner Jeffrey Rouse's report showed Smith was shot eight times the night he died — seven times in the back and once in the left side of his chest.

Fact and absolutely absurd.

quote:

Saying he needed to refute comments from the attorney for Hayes and reports in the media, he gave a detailed play-by-play of Smith’s family’s version of what happened that night. Attorney Peter Thomson also updated Racquel Smith’s condition, saying that she was shot in the right leg and suffered a fractured femur, and also shot in the left leg by a bullet that went through her thigh.

Fact

quote:

Thomson said the confrontation began after Smith braked quickly while traveling on Magazine Street after a Hummer stopped short in front of them. Smith, who was traveling with his wife and another couple, did not think they had even struck the car.

Lester won't believe this for the life of him, just because they drove funny.. must deserve to be sought out and gunned down.

quote:

“Afterward, the consensus in the car was that they didn’t hit the vehicle,” said Thomson. “Out of concern for the safety of his wife and the consensus in the car that we don’t know why this Hummer stopped… they continued around the Hummer and drove away.”

It isn't out of the norm to drive around, even if they sped away.

quote:

Thomson said that moments later, as they continued down Magazine Street, the Hummer came roaring up behind them and slammed into Smith’s Mercedes SUV with such force that he shattered the windows in Smith’s vehicle and jerked the heads back of everyone inside.

So was the rear window shattered? Is this a fact? If so that's a pretty raging a-hole with some intent.

quote:

“Shaken, Will checked first to make sure everyone in the car was okay. They were afraid. Will got out of the car. He wanted to find out why this guy – a very large man coming at Will – (had slammed his car).”

Why is this so hard to comprehend? Would absolutely be shocked and wanting to know exactly what the heck is going if you just got rear ended.

quote:

Thomson said words were exchanged and that Will wanted to know who the guy was and why he slammed into his car. “He’s yelling and cursing at Will… He’s enraged,” said Thomson. Thomson added that Racquel Smith and the other woman in the car came out to try to defuse the situation and thought that it had been successfully accomplished. “At this point, the killer follows them… suddenly two shots are fired. She is shot immediately in both legs and collapses. Right after the shooting of her, the killer unloads 6-8 shots into Will’s back.”

This will probably be able to be proven. And again, it goes to show he wasn't trying to just kill anyone and everyone.. He wanted to unleash his rage on Will. If they had bumped his precious Hummer prior, they very well may not have known to the extent or if it was an issue. Doesn't give him a right to go play judge and executioner over his rage.

quote:

Thomson also said that while Smith had a lawfully-licensed concealed gun in his vehicle, Smith never took it out and never fired.

Sad how originally so many skeptics wanted to just say Will was guilty because he had a concealed gun in his car. Even if Smith stated he had a gun, it doesn't mean he deserved to lose his life to that number of gun shots to his back.

quote:

“After the shooting, after the killer shot Will in the back eight times, the killer, we have evidence, had no remorse whatsoever,” said Thomson. “He stood over Will Smith’s body as his wife crawled away.”

Absolutely cold blooded if true. You just straight up killed someone, you going to just stand over their dead body. Even if justified, that's some serious arrogance.

I think ever one is over thinking this. only fact that matters is a unarmed man was shot in the back probably on his way to get his gun after seeing Hayes with one. Outside of a video showing Smith with a gun in his hand Hayes is farm bound

Ok. Now post some of the one sided comments by Thomson that would be bombshells if true

Both attorneys presented bombshells today, that of proven true, will all but sink the other side

The attorney for Cardell Hayes, the man accused of murdering former Saints player Will Smith, has said Hayes was calling 911 to report he had been the victim of a hit-and-run before he rear-ended Smith's SUV, leading to an altercation and Smith's fatal shooting April 9.

But a review of NOPD logs shows no record of a 911 call made to report a hit-and-run, or any other incident, in the Lower Garden District area around the time when the accident and later Smith's shooting took place, according to a review of police data by NOLA.com | The Times-Picayune.

Logs of 911 calls made April 9 show only two calls made from that immediate area late Saturday night: An 11:29 p.m. call to report Smith's homicide at Sophie Wright Place and Felicity Street, followed at 11:33 p.m. by a call made to report a car accident at that exact same location.

I refuse to believe any of this until I hear it roll from the reliable lips of CJ Mordock.

The logical response to your statement is that the driver gunned down a husband and wife in the streets of New Orleans for a bump and run. There was no safe "if this, then that". Who's to say the driver of the Hummer would not have started firing away in front of Juan's after the first incident if Smith had stopped. His subsequent actions certainly don't do anything to dispel the notion of that probability.

From the defense attorney's demeanor and this other attorney's tweets, they may in fact have video of a gun in Smith's hands.

No he wouldn't. Hayes still killed someone and has to answer for it.

but then go back to the tweet of his I posted questioning whether the bullet(s) that injured Racquel Smith came from Hayes gun

if it didn't... then there has to be a gun that NOPD can prove was fired and another casing

NOPD said either yesterday or Monday that ballistics tests were already done and only Hayes gun was fired and all spent bullets recovered belonged to Hayes gun (which can be proven definitely)

Why?

Quite a few here are waiting for facts, statements and evidence that don't come from lawyers who know jack sh!t.

Why is is assumed that Fuller is so "crafty and smart".

He gave an interview without taking a statement from his client. Then he referenced a witness that he never questioned.

Just today he suggested a cop hid Smiths gun to the media and said that Hayes idolized Will Smith yet had no idea who he was when he was shooting him.
