It wouldn't be shocking at all if this has happened since episodes have aired, but that's not why he was booted. It's obviously something that happened out on the island. There is a lot of dead time being boated around, plus they all have to film the one on one interviews, so no shortage of opportunity to get inappropriate and not have it caught by camera.
Sort of like when the big dude on the Davids tribe hurt his back on a boat ride a few seasons ago. No cameras rolling.

Sources tell PEOPLE that Spilo vehemently disagreed with the decision to remove him from the game.

I wonder if they had a bit of forethought after the day 22 fiasco.
If he made the final 3, the backlash would have been awful. Sounds like he was sandbagged a bit. Sort of like a make up call in football

He must have touched that leg in a certain way to where it was clear that it wasn't accidental.

Going to be a lot going on for the finale. I agree with some on here, Tommy will win if they don't turn on him first. Dean is a douche but has that advantage that could propel him to the end.

He hasn't even received a vote since the Kellee/Dan showdown. He was a sure bet for the final 3 as a goat and would have been a longshot for any votes considering the people already on the jury. This absolutely could be the case.

I wonder how the producers reconcile their decision to make a case against Dan but also showed last night, clearly (in my opinion), a clip where Elaine got grabby hands with a clearly annoyed Tommy while on the beach. Did she take his power? I couldn't be more annoyed with the show this season. I've been in and out of boats and vehicles where a leg or shoulder is used as a brace. At this point I'm not buying any of it. I think, as others have pointed out, that Dan was sure to be final three and the producers didn't like it.

I read this dude's recaps most weeks, and every season he does his ranking of all seasons. The dude has been covering Survivor since season 1 and is on site for most filmings/challenges, etc.
I don't agree with his whole list , but he has this one ranked dead last, which I totally agree with.

I’m a guy who tends to be pretty analytical. But even I recognize that when it comes to ranking Survivor seasons, it ultimately comes down to a feeling. If the reason is because of his accidental fall and grab on to someone, that is just plain stupid. Now, if he fell and went face first between her legs, different story.
This show had most definitely been annoying as frick.
Still going to watch though

I agree that what happened with Kellee didn't sit right, and the production crew stepping in and showing that in the episode just left this season with a weird vibe. Like the last season of The Office. It broke that wall. This season just hasn't been fun.

If they really did oust the guy over something incidental just to not have him in the final 3, that's totally breaking the entire spirit of Survivor, which is supposed to be microcosm of society. If the players in the game didn't want Dan gone, it shouldn't be their prerogative to remove him. He obviously really did creep Kellee out, but apparently no one else cared. I guess that sends the wrong message, even though that's the real message.
