With the Tolkien Estate having (I believe..) contractually obligated Amazon to certain provisions such as sticking to the 2nd age and not deviating from published story lines, this could be fertile ground for the Estate to sue Amazon if they somehow determine the "inclusion and diversity" breaches those provisions...
Having said that, you would also like to think the Lawyers for Amazon would be looking over the shoulders of those writing and casting the story to avoid that sort of thing...

Clearly this is a flashback / intro to the show. I didn't initially catch the 2 trees in the distance, but the series takes place afterwards.
I'm not overly optimistic, based on who the show has working / writing it, but we'll see.
