When you have public opinion on your side, you’re allowed to use it. Ohio State can and does do the same thing in retaliation

This is about trying to stick something to Urban. That's what it's always been about, at least for people like Brett McMurphy and the Hot Dog Water drinkers. If they can make it the entire organization, they'll do that, too.

McMurphy isn't a Michigan shill, he's a national sport writer. He really has no "side." It's just lazy journalism used for nothing more than to get clicks and to paint a misleading narrative for said clicks. This is something I would expect out of Clay Travis.

Im not sure that is as important as him driving drunk, and again, still being able to coach at Ohio State afterward.

maybe not, but the tweet takes the angle that it was a conspiracy that he had a DUI reduced because the judge was an alum.

Zach Smith, despite an ever growing rap sheet, has always seemed to skate repercussion. Someone has been protecting the guy.


For example, test refusal is an automatic 1yr license suspension in Ohio. It looks like his was only suspended 3months.

OSU's Self-Disclosure of Criminal Convictions says:

Failure to disclose could result in corrective action and/or removal from a position working or volunteering in activities and programs with minor participants.

1. What types of convictions must be disclosed?
A conviction occurs when an individual is found guilty, enters a guilty plea, or pleads no contest, to a felony or to a misdemeanor. An individual must disclose these types of convictions. Criminal traffic offenses, such as OVI (also referred to as OMVI, DUI, or DWI [driving/operating a motor vehicle under the influence]), failure to stop after an accident (also referred to as “hit skip”), and driving under suspension, must be disclosed. If convicted of an offense with the potential for the imposition of a jail or prison sentence, even if a jail or prison sentence is not imposed, err on the side of caution and disclose the conviction.


FWIW, physical control could result in imprisonment for up to 180 days.

I'm not sure how the policy read in 2013, but if it was, there is no reason to believe Smith didn't disclose it. It's very likely OSU knew about the conviction.

Is that a big deal? No, not by itself.

180 days is 6 months, not 3. The OH implied consent laws are actually pretty convoluted. I don't really care to spend the time going through all of it, but from what I gather, the suspension length can range from 6 months to 3 years. In most states, yes it's an automatic year's suspension. Ohio has the longest implied consent statute I've ever seen LINK
