Stewart, 43, hasn’t been criminally charged in Ward’s death, but TV legal analyst Rob Becker said it’s likely he will be.
“What happens when you hit that throttle is the car is going to move to the right .?.?. Stewart had to know that if he hit the throttle with a man standing on the dirt to his right, there was a good chance the car would hit him, which means there’s a good chance he could be killed,” Becker said Fox Sports 1.
“To me, that’s reckless homicide. That’s manslaughter in the second degree.”

Paul Kinney — who was also competing when Stewart’s car struck driver Kevin Ward Jr. on a dirt track in Canandaigua Saturday — said he clearly saw Ward on the track and managed to dodge him himself.
“I seen Kevin clear as day. Nobody else ran into him, either,” he told NBC News, noting he was close enough to see Ward’s face after the 20-year-old stepped out of his car, angrily gesturing at Stewart.
“It’s not a good idea to get out of your car and run towards other cars,’’ Kinney said.
As for Stewart, “Nobody can speak for Tony. Only Tony knows exactly what happened.”

A day or two later Becker backtracked, outlining how Stewart killing Ward could have been completely accidental, but also saying “a civil suit against Stewart is almost a foregone conclusion.”

Honest answer. The odds of tony not knowing what the caution was for is slim to none. You wreck a guy, look in the rearview, and his car is parked facing the wrong direction.

I just would like to note my opinion that tony had some sort of malicious intent in the incident. It shouldn't go without punishment.

Because people love to speculate without facts.

New York has a contributory negligence law so I wonder how this is going to work out

I do know enough to know that Stewart is a hot head who likes confrontation. Did he see Ward and attempt to scare him by running close to him? I could believe that. Do I think at all that he intentionally hit him? No, I can't picture that he would truly do that, but I don't know him personally. A tragic accident that could have been avoided.
If Ward does what he is supposed to do, he's alive today.
I agree with all of this. I don't see how the video helps one way or another. After watching it multiple times at different speeds, I actually feel like when Tony comes into frame that it appears he has either lost control of the car or caught a part of the track and was trying to correct it. The car does appear to be headed in a direct trajectory with ward but it also appears the rear tires are wiping around already. The only thing I am not sure about is the timing of the rev. It could have been to try and regain control.
I never thought that Tony intentionally ran the kid over. I did think it was a buzz by that went wrong and now I am not sure of that anymore.

Do drivers have spotters on tracks like this?

How does that differ from comparative negligence?
Posted on 8/13/14 at 9:20 pm to TigeRoots
After the sheriff says that the investigation is final and no charges will be filed.

I say Tony won't race again this season.

Comparative negligence involved apportioning fault to all parties that played a role in an incident.
Contributory negligence involved looking at the victim's level of fault for the injury, i.e. exiting a racecar in the middle of a track.
