I think it's interesting the affidavits were signed before Leach released the "statements". Makes me wonder if Leach even knew about the affidavits before he started talking. The affidavits make Leach look like a liar regardless of whether you agree or disagree with the treatment of James.

Also, whether Craig James or the boy were pains in the asses, is wholly irrelevant to Leach's actions. The only relevant issue is the concussion and the fact that the kid couldn't practice. Leach initially defended his actions as those to protect the boy, basically. That was working out well, so now, Leach is trying to cloud the story with something else. He's trashing Craig in his defense, which is a stupid comeback, true or not. Trashing the kid isn't going to help him either. A judge or jury is going to say putting him in a dark room with no windows and nothing to sit on is stupid. Any doctor will say it's not wise. Kid could have walked around and gotten dizzy or disoriented and fallen down, for example.
Leach's atty should have shut up and told Leach to shut up. Grave is getting dug deeper every time one of them opens his mouth, from a legal standpoint.
Doesn't matter if the public thinks this was a no big deal thing. The facts are the facts and no doctor is going to testify that this was a recommended action. He'll get no experts on his side.

As far as I've seen the kid wasn't harmed, physically, as stated by the team doc. Whether he could have been harmed has not been addressed, but I don't think that's relevant either when it comes to Leach defending himself. It's the act that's relevant. Leach is just lucky there was no harm.

Which is why the trainer's affidavit is important, especially for Tech.
Disregarding the advice of the team trainer when it comes to a player, is the cause that Tech needs to win any type of wrongful termination suit Leach may bring.
It's going to be a tough sell for Leach's lawyers to win any type of suit now. I still predict a settlement though. Leach will get some money but not the value of his contract that he signed.

The trainer is still in some serious trouble with NATA and Texas boards. At no time should he allow for a coach to enter his scope of responisbility.
The two signed affidavits have shown that Tech did everything right, they started investigation, Leach responded by trying to file an injunction, and they responded by firing.
No matter what you think of Leach or James, Tech was and is completely in the right and covered every base.

If I'm Tech, I'm not settling. Dragging this out in a public courtroom is not in Leach's best interest. He's got the burden of proof and, right now, it's an uphill battle for him. He should move on and hope for a good job. He also better be ready to sign some of the same language that Tech wanted him to sign before they fired him. He'll be asked to do so, if he goes to another school.

The affadavits were signed on 1/1/10. Later the Admins said it was from info gathered on 12/19/09. Why the delay and was the trainer coerced?
I hope Leach takes it all the way and then the courts can decide who's telling the truth.

Did you ask that question when it was realeased that the trainer said James was lying or are you just asking it now when it comes out that he disagreed with Leach putting him whereever he put him?

How is that relevant to the question? It should be incredibly obvious any coercion would come from Tech - Leach has no power over the trainer as of 12/30/09, Texas Tech had and still has the guy's job over his head. Should be a no-brainer that the question would be asked later.
Now, if you'd actually like to answer the question, feel free, but answer it, don't ask a question that manages to be pointed and pointless at the same time.

right but those trainers statements were released by Leachs people back when Leach was still the head coach correct? I think the point he is getting at,is that people are starting to see conspiracy's just to not admit that Leach might have done something wrong
