HIPAA isn't an oath, it's a law. And much like any other one ignorance of the law is not a defense.
That hospital has posters explaining patient rights and HIPAA. Every hospital does, this is also part of the law.

james harrison just tweeted to schefter

I can only hope that the release of this costs schefter his job.
Schefter didn't violate any laws. The doctor did. HIPAA applies to healthcare providers and payers, not news organizations.
Now was it ethical journalism? Probably not.

The real question is who did it.
I doubt the doctor did it. My money is on a nurse or one of the techs.

I thought HIPAA was an oath taken only by those in the health care industry?

Buddy texted me a pic that is out there.
It is absolutely disgusting. His hand was completely fricked. Makes me never want to mess with fireworks again.

there is no question that someone at the hospital is in deep doo doo and violated HIPAA.
But the public release was perpetrated by Schefter. If you think he has a wall to protect him, i would think again.
and ultimately that decision is to be made by a judge

What are you citing here? You are demonstrating a complete lack of any understanding on the subject.

if you take a picture of my medical chart and sent it in a text to someone at 123News station. And the person at 123news blasts it out over the air, are you suggesting that the individual at 123 is immune to any recourse?
you cannot give the individual at 123news permission to broadcast that information.

I don't know if people understand how serious this is. Aside from dumping JPP info, there's a 2nd unrelated Pt's info included. I doubt ESPN legal ok'd that
Also, not only is the person who leaked this going to get fired, the hospital itself could face serious consequences up to loss of accreditation. This is a federal crime punishable by jail time.
So many lives have been ruined just so a reporter could scoop Twitter
I don't disagree with you, but I wonder if there is any sort of protection sicne the actual picture doesn't disclose anyone's name (especially in regards to the other patient whose info is in the pic).
Just wondering if the fact that they simply say the sex and age.
Although looking at the pic again before hitting submit, it appears to also have their initials as well.

Post it.
I googled "Jason Pierre Paul hand" and got nothing, except for this awesome piece of work right here:

bullshite. That picture has been proven not to be of jpp, he has/had tattoos.

I have to think AS has an email from ESPN giving him the "green light". If so, he's protected.
