Jameis Winston fires back, suing woman who accused him of rape

Instead, the former Florida State University quarterback-turned-top NFL draft pick has fired back against the woman who accused him of rape.
Weeks after ex-FSU student Erica Kinsman filed a lawsuit against him, Winston responded with a counterclaim filed Friday in a Florida court asking for a jury trial. His lawsuit claims Kinsman had consensual sexual relations with Winston, subsequently lied about it repeatedly, publicly tarnished his image and demanded $7 million in order to drop her case.
"She has mounted a false and vicious media campaign to vilify Mr. Winston with the objective of getting him to pay her to go away," states the Heisman Trophy winner's lawsuit. "Ms. Kinsman is motivated by the most insidious objectives -- greed."
John Clune, who is Kinsman's lawyer, responded by saying Winston's "counterclaims put all of his prior misconduct and background front and center in the case by alleging injury to his 'good reputation.'
"The burden of proof is now on him," Clune said. "Refusing to answer questions and smearing people in the media aren't going to fly here. I'm not sure how well that will end up for him in this case."

I see no problem going after someone responsible for part of your bad image. Without the rape allegations he wouldn't be nearly as big a villain that he's seen as today

Media spent more time/energy on fake rape accusations and the shopping misunderstanding (crab legs) than on the real rape case (Sharper) or murder case (Hernandez).

That's probably why he's going forward. His other off-field problems contributed to his bad reputation, but none of them are as bad as a rape allegation.
Plus the inconsistencies are enough to get her laughed out of any civil or criminal court, but Jameis probably feels a defamation verdict in his favor would clera his name in a way that he can't get from the lack of an indictment.

I don't look at a civil suit answer and counterclaim as Winston suing her, the way most people would think of "suing" someone.

What are the actual facts of the case? I've heard a lot of different versions (no DNA test was done, the DNA test showed two other men and not Jameis, etc.)

From what I remember, the facts weren't in her favor, but it's not like Tallahassee police were really pursuing the case.
