Playeda couple of courses where the OB wasn't staked and the scorecard didn't reference it, so I played my ball out of someone's backyard.
Probably should have taken stroke and distance, but I didn't.

assumption of risk..person assumes the risk when driving by a golf course, or parking by a baseball field.
Owners of houses on the golf course are typically deemed to have assumed the risk as well.
As for cars passing on streets, there is no such assumption of the risk. Golf courses have been held liable due to negligent design in creating a hazard as have golfers who struck the shot. This type of case could go either way and there is very little case law on.

I am right handed and usually hit a draw. I have played that course twice and both times hit a push landing in the middle of the road. When that ball is bouncing all you can do is yell at the cars to hurry or slow down

My parents live on a golf course and do not have a fenced yard. 90% of people retrieve the ball and 25% are assholes and drive the cart into the yard.

I live on a golf couse - actually green on a par 5- my house gets hits very seldom and I do finds balls in my yard sometimes. I have played Santa Maria and broke aguys window on the back nine and paid for it - I thought it was the right thing to do. If someone broke my window I would hope they would pay for it. I'm sure legally their is alaw some where about this - but I'm unsure in the homeowner or the golfer assumes the risk.

It depends legally. If a course has been there 80 years and you build a house 150 yds down the right side of a fairway, you are assuming the risk. If a new course cuts up against your back yard, it is different. There is no negligence in hitting an errant ball...perhaps there is if you are GWI or in drugs..

If I can see it, and Im pretty sure its mine, then yea I'll go get it, but not if its like on their patio or something like that, only if it close.....Dont want to get shot while playing.

I wont hop a fence. There are 3 houses in oak harbor that received brand new callaway tour iS balls from me last friday. I hit the roof on one so they can have them.

I'll usually go get it if there is no fence and I can see it. Most homeowners that live on a course are reasonable to deal with, of course they do have some a-holes who think nobody should ever slice or hook into their domain.
Not to hijack the thread but are there houses close to the fairways at the Lakes Course at PP? I had an email about a $12 after 12pm special and thought about taking my son but I don't want to pay for broken windows. He hits it a long way but tends to push/slice.....only been playing a few months at most.

Only on a couple of holes for the lakes course
There's one where they have an outdoor veranda and they have a huge net in front of it, they know what's up

Thanks, I may take him Friday. We played at Barriere 3 times this month and he has driven better each time.....he blew the ball by me on 4 holes in a row, now if he could only pitch.
