Sure as hell sounds like murder to me.

How the frick this individual is free to go home to his own bed is fricking beyond me.

Jesus.

perhaps you are jumping to conclusions and there is more than meets the eye.

or perhaps it did happen just how the witness said it happened and within a week or so he'll be charged with murder.

being released within 24 hours by law does not = congrats on getting away with murder. go live the rest of your life in happiness.

Fwiw, that cop that was just cleared of killing that guy with a gun in SC the witness said he was reading a book and wasn't armed or something. A witness has a value in the case for sure but there are many times that the witness doesn't have an accurate account of the actual events. I would say Glasser's story to the police was much different and now they would need to gather all the evidence to pursue Charges and that evidence will point to which Charges to actually proceed with.

That said, Im very saddened for the loss and if he was apologizing before being shot that is truly disgusting and I would hope for life in prison with no parole.

Still amazes me how the media jumps to conclusions and rolls with stories without a all the facts. That leads to most of the trouble in the country. A story saying Joe McKnight dead after being shot by or in his car And leave it at that. Just like the OSU attack where they kept saying gunman but he didn't have a gun. Just wait til the facts.

Likely, and completely reasonable.

I think we all agree there.

What is the precedence in a situation like this?? Everyone on my facebook is saying the typical if he was black he'd still be in jail yada yada yada...

Common sense tells you that the guy should still be behind bars but what is the actual legal proceedings for something like this? Is it completely out of the norm for a guy to be released under these circumstances?

ETA: I'm not picking sides, I just want to know the legal procedure for this because my facebook is on fire right now

I really couldn't say. But you have to release someone within 24 hours if you aren't going to charge them yet. If his account of the situation differs from the eyewitness (which again i have no idea if it does) i'd say it's pretty standard to release the person. They may have to build a case and that doesn't happen in an hour like on cop shows.

I don't pay attention to the drivel of facebook.

Also an eyewitness spoke to the media. That doesn't mean they've given their statement to the police yet. And it's quite possible the police are trying to corroborate that eyewitnesses story since we know eyewitness testimony can be extremely unreliable at times.

I have no insight, just stating reasonable reasons why he may have been released for the time being while the investigation moves forward.

The "witnesses" that run to the media are usually not the ones you should listen to.

For them to release him before the 24 hour mark, shows me the witnesses that spoke with police have a completely different story, or there is actual video evidence.

Thanks bbap for answering that

So this is standard procedure but yet people are freaking out about it?? Look, I get that people are upset about it but they at least need to more educated before being so opinionated... that's why I ask the questions I do

McKnight was shot in hand, shoulder and below his chest. A couple of the bullets caused fatal damage to some of his organs, coroner says.

Jonathan Bullington ?@jrbullington 20m20 minutes ago
Sheriff: Gasser didn't stand over McKnight and fire. 3 casings in car.

Jonathan Bullington ?@jrbullington 20m20 minutes ago
Sheriff: no video we've recovered. No witness account of apology being made by McKnight to Gasser

Ramon Antonio Vargas ?@RVargasAdvocate 13m13 minutes ago
Coroner: Joe McKnight's 3 gunshots wounds are not consistent with being shot by someone standing over him.

the "eyewitness" should honestly face charges. I mean its one thing to be off on what happened.....she straight up fricking lied. That or the paper should do a better job of deciding if the person is credible before printing it.
