A lot of misinformation in this thread.
In 2006, a bill named Unlawful Internet Gaming Act was passed, that the NFL was at least partially behind, which made it illegal for a US financial institution to make a financial transaction with an offshore gambling company. This cut off funding to the online gambling sites from the US. This bill had a special carve out for fantasy sports and horse racing.
That carve out expressly states that Daily Fantasy Sports is completely legal federally, so it is not going away any time soon.
The 5 states or so where DraftKings and Fanduel do not service customers is due to those states having some sort previous online gambling laws on the books. As far to my knowledge there are no laws that expressly outlaw DFS, but more than likely the lawyers for the sites just told the sites to not service players in those states to avoid any issues.
Louisiana had a bill to legalize DFS completely within the state, but the land based casinos and Family First organization had it shot down.

We know the history. We are claiming that DFS being allowed and neither poker nor line sports betting being legal is bullshite.

Apparently you do not, because online poker is not illegal on a federal level, and hence Nevada, New Jersey have it within their states lines. The shutdown of the major online poker sites in 2011 was due to bank fraud and money laundering that the poker sites blatantly did to circumvent UIGEA.
Also UIGEA clearly legalizing DFS is why one is legal and the other is not.
Now from theoretical argument why one is legal while the other is not legal, sure they are pretty much the same thing. Similar to why alcohol is legal while weed is not. Politics and money, plain and simple.

I think it will get passed next year.
The rep that tried to pass the bill tried to do it with little help. Evidently the Fantasy Sports Trade Association(whom he didnt prompt this go-round) is going to step in and help out. Also 70% of the LA residents polled support the full legalization of fantasy sports, and the bill will also be backed by the Saints & Pelicans.

There's no reason why this and other forms do gambling are illegal.

FanDuel is awesome, I play NFL, CFB, and MLB weekly, prefer it over regular fantasy. College football is probably the funnest, love the late games one JuJu carried me yesterday.
Never tried DraftKings, would assume it's solid as well.

Nice try at shaming tactic. The market to fanduel/draft king is still in it's infancy, meaning that the market is still soft. I know a group of professional handicappers who now focus solely on this and they are making a killing. I mean a killing.

I can easily see how handicappers and people that have the time to sit down and do research could clean up on daily baseball leagues.
And yes the commericals are horrible, especially now that Hulu Plus plays them too.
