Roofdog, In my opinion, I think you should find others who were asked to pay the 3k back to the state and find an attorney who handles this type of case to see what he thinks. In the meantime, ask the state for a letter stating their reasoning for denial.

Was told i would not be getting a letter. Was told i was verbally notified of my balance due by phone. The matter of the flex fuel is under review by the dept and they do not know when a resolution will be reached.

You have the right to receive any directive from anyone in writing for documentation. I would demand it...

Thats the problem. They cant give me anything in writing because nothing is finalized. Thats my beef with the balance due, it makes no sense. It is not justified

I would hold the money. I agree with Duckslayer. Until a policy is finalized and until you know how others who have received the credit will be treated, I would not remit.

I am going to wait on the ruling. My fear is that it could impact my credit score if the ruling doesn't make it by may 15th.

Why would it impact your credit score?

Only way that would happen is if they slapped a lien on you. Im sure you would be notified if they would do that.

What will be interesting to see is what
Time periods they will disallow. Also my fear is that they pick a random day in march as a cutoff date. If they were to disallow the flex fuels, why not just make it effective
Next tax season?

Ok guys. Have you thought about this? Are there even any alternative fuel vehicles in existence that cannot use gas or diesel as a backup fuel? Are there any 100% alt fuel vehicles in existence thst cannot still use gas?

Pecanman, can the state cut the credit for flex fuels off mid season? Like for instance , a certain date? Or will they have to be retroactive or prospectively from may 15th?

They would have to follow the state law regarding alternative fuel vehicles whenever the law went into effect. So, in my opinion, if they erroneously gave out credits when they should not have, then they will go back to 2009. If they don't do this, then credits for all should be allowed on Flex Fuel vehicles until the law is clarified.

Well guys, I got my notice of tax due letter last Friday. The only explanation was the following: "CHANGES IN PERIOD HAVE INVALIDATED THIS REFUND". They gave me until MAY 10 to pay it back or they threatened possible collection action. The amount was listed as tax due and not a refund, so it looks like I actually owed tax for the period. THEY HAVE NOT MADE A RULING YET. HOW CAN THEY BILL A TAXPAYER FOR A REFUND THEY ARE STILL GRANTING!!!??????

I got mine too

My other thought is...sorry Roof, but to me it sounds like you fricked your shite up. You screwed the paperwork up and you got more than a few set of eyes looking at it. Then they denied it, because it was messed up. I had no problems. They sent me a debit card with the full amount.

Thanks for the kind remarks guys. I hold all three major accounting certifications. I AINT NO FRICKING LIAR AND I HAVE MY SHITE TOGETHER! RECEIVED MY REFUND AFTER AN AUDITOR PROCESSED IT AND APPROVED IT. Two days later the auditor called me and told me that i had to pay it back because flex fuels were no longer accepted. She told me that she received the this word from policies. My truck qualified fair and square. I have a balance due letter plain as day. I've been fighting this since february 12. I dont know why i've been singled out, but i am. Nothing i can do about being singled out. But i dont like being accused of lying or whatever.
