Lots of dealerships advised buyers of this credit as well. The state got federal funds for the program. They won't get federal funds to pay for legal representation/penalties. I think the math can be done rather quickly with regard to the outcome of the credit.

I posted this photo on another link. As you can see, H&R block customers are filing for this credit as well.

Roofdog, you might want to look into the Audit Protest Board within the Dept. of Revenue. Since you have done extensive research on the credit and have proper documentation, you can argue your claim. You should file ASAP.

iknowmorethanyou, from my dealings with them, they are working to disallow the flex fuel vehicles from the credit. i was told today by a rep that "they are leaning that way".

pecanman, considering i got my refund after they approved the return and the credit. i don't think i am able to file an audit protest. i am currently expecting a call back where someone is supposed to tell me why i have a balance due on my account when the tax issue in question has not been resolved according to their plans.

that can't be done without amending the law.
the law cant be amended this year and it would be July 2013 at the earliest.

I just called LDR to ask if the maximum credit is $3000 per vehicle or taxpayer. I did not say that i had a flex fuel, just that it was a qualifying vehicle. She kept me on hold while she spoke with another department and told me that the credit is no longer available.

So they are dropping a credit mid-tax season? Oh this is priceless. Is this even legal? Sounds like the plan is to drop the credit since the law is set in stone. Others should call to see what theyre told....

Fwiw, i just read the reg again, the reg establishesthe credit. So they cant just drop the credit. Nice try.

The technicality is that E85 still burns gasoline. Alternative fuel means alternative to gasoline or diesel. Since there is still some gasoline being burned, this is going to be their arguement. I have not seen in the LA state statute where E85 is an acceptable alternative fuel. Only, for example, straight ethanol or methanol, propane...

Pecanman, one of the posters in one if the original threads found somewhere that E85 is considered alternative fuel because of the majority makeup i want to say ge found it in the dept of energy us website not sure though. This was the piece of data i used to convince me to file . I questioned the posters about that many times.

It passes the Clean Air Admissions test. Therefore, according the US Department of Energy, it qualifies as an alternative fuel vehicle.

This is what I was told by the Dept of Energy and I have it in writing as well. Pecanman, what are you trying to prove here man?

Duckslayer, my intent in what I wrote was to try to think what the state's arguement is going to be based on the email I received from Cheryl Bankhead at the LA Dept of Revenue on March 22. Her arguement in the email is that Flex Fuel vehicles still use some gasoline and she cited Rev. Statute 47:6035. This is their current arguement, not mine. Period.
