Exactly. His urine was tested and passed for PEH. Technically he wasn’t even tested for Mary Jane if I remember correctly I am guessing and Vol probably knows more so correct me if I’m wrong but there’s supposedly a gray area which makes a case for Fulton. I am thinking if his urine was properly taken and sent off probably with nurse watching and he passed the PED’s then he should have never been suspended for 2 years. So if the sample that passed was was done properly then technically it wasn’t tampered with. Just a guess though obviously

Two year suspension for attempting to cheat on a drug test is literally insane. The NCAA has been given too much power over the careers and lives of athletes and coaches. Dale Brown fought these fascist bastards his entire career. And until enough universities secede or at least form a separate group to overrule NCAA actions, overkill of this nature will continue to occur. Suspending Fulton's career for 2 years should not happen. And there is no power to step in and hold the NCAA accountable for their unjust decisions.

The NCAA is vulnerable to litigation.
Look at the Cam Newton and Johnny Manziel situations for example. As soon as the lawyers came at the NCAA they folded.
Then there’s antitrust and the inequities of making money off of athletes that don’t share in the profits but generate multi millions while risking serious injury.
Not to mention the growing awareness of brain damage and concussions from playing.
They’re exposed imo to liability. A real paper tiger.
Fulton should be eligible and I have a feeling he will.

Getting Fulton back game 1 would be huge!

No, it's not "literally" insane. Every sports authority on the goddamn planet must be insane because the universal punishment for cheating and then lying about it during the investigation is always worse than cheating and not lying about it.

But I don't think he cheated. From what I have read he chickened out and then admitted to what he intended to do but he did not do.

The tester saw him attempting to pour someone else's urine into his specimen cup. My understanding is the rule we are arguing is that the moment the tester saw that happen, it should have been deemed a failed test and he not allowed to submit a sample. Therefore a failed test = 1 year. Since he never actually handed over an altered sample, the first rule should apply, and not the altered sample 2 year ban. Should be a 1 year failed test penalty, if which he has already served.

He absolutely has served his time. Taking two years away from a kid is ridiculous. Far greater crimes within the NCAA jurisdiction serve less than two years.

Try to understand this...he didnt cheat, he didnt try to chest! There is no "cheating " a urine test without it having a sample turned in. You haven't turned in a sample and attempted to cheat without sealing it and signing the seal and handing to collector.
Theres so many loose strings with this situation that a lawyer could argue quite a few.
No doubt he gets reinstated. The NCAA might do some wierd shite and maybe say he has to sit 1 or 2 games, but KF is playing this year period

Logically, that's a weak argument.
A better argument logically is that there is a tampered test (1 year) and either an associated failed test or failure to produce a non tampered sample (1 year). The latter actually didn't happen.
It doesn't matter. The only thing that matters is that we get Fulton. If it's a bogus argument and we still get him back, I'm ecstatic.
