The NCAA is going to rehear his case and Fulton's attorney sees this as a positive since the NCAA usually doesn't rehear cases.

This is positive...
But doesnt mean the NCAA is going to do anything.... just temper your expectations.
They could say "we hear ya,but sorry. Ruling stands"

They could have already done that based on the pleadings filed though. They didn’t have to grant a new hearing so why would they if they aren’t already seriously considering lowering the penalty?

So he's getting a new hearing?? Wow that's huge if true. Almost certain that they will work with the young man if he gets a new hearing.

I think it's only right for the young man. He made a simple mistake and shouldn't have to sit out half of his career for that. A year is fine.

Optics.

They can say "we reheard all arguments and revisited the case in its entirety and found he violated the rule as written and was given the punishment as written. We will revisit this rule, punishment, and the fairness of it going forward, but no retroactive changes will be made"

No need for "optics". They've done way worse before and not given a frick.

It's been apparent for many many years that the NCAA doesn't give a shite that they look like total buffoons, in my opinion.

The NCAA does not give a flying frick about optics. They are a self governed voluntary membership body. There is no other way to slice it, then revisiting this is good news and not a step they were in any way compelled to take.

Totally agree. I hope we get some good news. Just tempering my expectations a tad. I don't ever trust them to make a decision that actually benefits a student athlete.

Technically, they aren't even rehearing the case at this point.

Fulton's side has stated there is new evidence and facts that may have had a bearing on the outcome of the original hearing had they been considered at that time. NCAA committee has said we will take a look at this new information and if they determine it could have had an effect on the original hearing, then they will open the case back up, reconsider all the facts/evidence (including the new) and decide if the penalty should be reduced or eliminated all together.

All true but the NCAA currently considers it closed. They have no obligation to allow a reconsideration to be filed, but the new administrator at the NCAA is allowing it based on the evidence presented. That person is forming the committee which will decide to re-open the case or not. The committee will re-open the case only if they believe the new evidence would have changed the penalty, so if they do, and Fulton’s lawyer thinks they will, then it will be to lessen to suspension. Hopefully to one year and time served. Still possible the committee decides nothing has changed, but this is definitely a very positive step, not just the NCAA following protocol.

Agreed. I never said it was negative or not a positive; just that there are more hoops to jump through to get to the rehearing stage, which is certainly something more than nothing and is always a positive in legal proceedings.

I also agree that if they manage to get to the rehearing stage, that something will happen in a positive manner for Fulton. I don't know if it will be as great as automatic reinstatement, but it'll be better than what he has. They won't let it get to that step just to waste everyone's time and leave the penalty as is.

Not sure what the new evidence is. The article written today didn't say. May have been in the original article from about a month ago where it was talked about the family pursuing this route.
