We have already been down this road. The NCAA is going to lose that fight.
I understand NIL and the legalities around that, but I don’t understand why the NCAA suddenly can’t determine eligibility rules for their sports. I mean, they have rules about how many years a kid can play, specific academic requirements as to whether they can play, etc. but for some reason, they can’t enforce this transfer thing? I mean, what’s to stop a guy from getting drafted, playing in the NFL for a year, getting cut and then coming back to college and continuing to get paid…I know this is a far fetched example, but it still centers on eligibility to play…same as the transfer rules.

And get paid by someone however much that person wants to pay them. This IS capitalism at its finest. If you don’t love it, you are a communist .
Sounds like players should sign contracts then. Or are those communist too?

In short, the sit-out rule was argued to be an anti-trust violation.
quote:
At bottom, the court's ruling blocked the NCAA from enforcing its multiyear transfer restriction for 14 days and prohibited the NCAA from enforcing its Rule of Restitution [1] (Bylaw 12.11.4.2) during these 14 days. However, on December 15, the seven AGs and the NCAA agreed to convert the 14-day temporary restraining order (TRO) into a preliminary injunction, with the NCAA agreeing to suspend enforcement of its transfer restrictions through the end of the 2023-2024 spring sports season. [2]
The complaints allege the NCAA transfer rule violates U.S. antitrust laws. NCAA bylaws delay the eligibility of certain student-athletes when they transfer schools. The complaints claim the rule "unjustifiability restrains the ability of these college athletes to engage in the market for their labor as NCAA Division I college athletes." Namely, the rule often requires student-athletes to sit out a year after a transfer before competing in games with their new school.

Challenges to the eligibility rules are already starting to make their way into the courts. Notably, Diego Pavia, the Vandy QB asked for (and was denied) the opportunity to continue playing college football despite the fact he is out of eligibility after the bowl game.
quote:
NASHVILLE, Tenn. (AP) — A federal judge took Diego Pavia ‘s request for a limited preliminary injunction under advisement at the end of a hearing Wednesday as the Vanderbilt quarterback seeks to play at least another season while his lawsuit against the NCAA plays out in court.
Pavia's argument is his two years in JUCO shouldn't count against his eligibility and that he should have, at least, 1 more year to play CFB. In the hearing his attorney kind of said the quiet part out loud...
quote:
“His best opportunity to earn a living is playing college football ...,” Downton said in court. “This is his chance.”
In essence, he's arguing to be a "professional" college football player. Now, the one slight hang up is since the team is tied to the school the player has to be a student to be eligible. I don't think the courts are ready to go that far in essentially saying non-students can play CFB. But make no mistake, challenges are coming seeking to change the limitations on eligibility arguing, in theory, as long as a guy is a student at the school he is eligible to play college football...for 6, 7, 10, 12 years!

ESPN just had their highest year of viewership of college football ever. So……
That could also mean less people attending games too.

Does this thread exist if LSU is cleaning up in the portal and has their NIL program together?
Probably not.
There are plenty of teams out there that have welcomed and embraced this change. There is no denying we are seeing new levels of parity in the sport due to the portal and NIL.

It renders the idea of team almost moot.

And? Any student can chose to transfer schools, why is it different for athletes? Because they get a scholarship they can never leave?

I’m not against capitalism, I just didn’t think this soon into the NIL era, we would see multi million dollar contracts.

Based on the comments of the Rant, I believe that there are less passionate fans here today than there were 4-5 years ago. If so, at least based on this demographic, enthusiasm is waning, and I’d guess if the Rants rabid fan base is waning, the general public’s enthusiasm is waning more so.

Schools will need to recruit rich donors to support a winning program. Without involved rich donors you are getting leftovers

No emotional attachment. Is that how it should be? We are adults after all.

Everyone is way richer except the fans that are subsidizing this bullshite. Sooner or later fans will wake up and it’s over.

The infinite transfer portal sets up a perpetual theme of quitting and looking elsewhere whenever things don't go their way. It's just like XBOX. Just hit reset & start another game.
This quitting will leak into other areas of their lives. They'll quit on relationships, jobs, & anything else that doesn't go their way as quickly as they'd like. It builds ZERO character.
