Where the f'ck did you grow up/go to school?

Having spent 5 years at LSU, I never saw this done by any acquaintance or friend. And, I spent many a night drunk off my arse or being a designated driver on other occasions. This was one sick f'ing bastard and anyone who thinks this is normal for any drunk person of ANY f'ing age, deserve to f'ing live the rest of their miserable life in Alabama.

Oh trust me, I agree. I didn't do that shite either. I'm just going off of what a bunch of people on here wrote. I was shocked to see how many people chime in and say, "oh yeah we used to do that to each other all the time!"

I have a confession to make. I thought the guy would be on TV crying and saying he did not know what he was doing. Now that he's taking a different course I hope he goes to jail.

Any ideas how a jury would rule on this? Do they have sympathy for a drunk parent rubbing his private parts on a passed out college student from an opposing team after a football game?

If you murder somebody you know at your daddy's camp is it better than murdering a stranger?

I'm on record saying he should be prosecuted (just not in prison for multiple years), but a crime is a crime. You can't have it both ways. Is it a crime to you or a prank?

And the if the DA pursues a charge under (A)(3) he is frickED


§43.1. Sexual battery
A. Sexual battery is the intentional touching of the anus or genitals of the victim by the offender using any instrumentality or any part of the body of the offender, or the touching of the anus or genitals of the offender by the victim using any instrumentality or any part of the body of the victim, when any of the following occur:
(1) The offender acts without the consent of the victim.
(2) The act is consensual but the other person, who is not the spouse of the offender, has not yet attained fifteen years of age and is at least three years younger than the offender.
(3) The offender is seventeen years of age or older and any of the following exist:
(a) The act is without consent of the victim, and the victim is prevented from resisting the act because either of the following conditions exist:
(i) The victim has paraplegia, quadriplegia, or is otherwise physically incapable of preventing the act due to a physical disability.
(ii) The victim is incapable, through unsoundness of mind, of understanding the nature of the act, and the offender knew or should have known of the victim's incapacity.

(3) Whoever commits the crime of sexual battery by violating the provisions of Paragraph (A)(3) of this Section shall be imprisoned at hard labor for not less than twenty-five years nor more than ninety-nine years. At least twenty-five years of the sentence imposed shall be served without benefit of parole, probation, or suspension of sentence.

That's not a prank either way. That is blatant sexual assault/battery by definition of the law.

Holy shite! I honestly did not see that part. Well throw everything I said about a suspended sentence out the window.

And if Downing is smart, he'll keep his mouth shut because his life will be in a judge's hands. Might not want to piss that man off.

There is a huge difference between drunk friends doing dumb drunk shite to each other and a random drunk dude sexually assaulting a stranger passed out.

When I was growing up my friends and I did all kinds of dumb shite to each other. One bet we had was to play one on one basketball and the winner would take his ball sweat and wipe it across the losers forehead. Sick right? we were teenagers, it was humiliating, and it made you REALLY not want to lose. It was funny for the spectators.

Now if i went up and wiped my ball sweat on a random dudes head I would expect to get an serious arse whooping. As an adult I would expect to get an arse whooping or go to jail for assault. Same action - different scenario and different results...
