re: So is this just the SEC is laying the framework to kick us out if we roster the players?

Basically, but I don't think they're really serious about kicking us out. This is them setting up the framework to punish us if we roster the players. I doubt it would extend all the way to expulsion

won't we be held in contempt of court if we dont roster them or did I read that wrong?

somewhat

this is actually more about them exerting their power to make and enforce rules outside of the NCAA framework.

only problem is Greg kind of fricked up a good bit on the stand

1) he claimed they couldnt play because of ncaa rules, not sec rules. that fricks them on that part
2) he didnt know that the actual NCAA rule actually doesnt exclude them
3) He has allowed others to play, like chambliss, that were ruled ineligible by the ncaa
4) when asked if the someone playing in the G league would be considered a PRO, he said yes, yet he didnt move to kick Bama out

in the end the SEC will be very lucky to win in the end because of lack of clear enforcement of rules, lack of clear rules and lack of consistency

I still think this was a bad move from the Start by LSU and said as much, because its a hit to the brand, even if you dont roster the players. Its not worth it at all

But Sankey is a dumb frick and has screwed up left and right on this, even the claim today that lack of statements by LSU admin meaning lack of institutional control is a huge frick up.

i do not think they try and kick LSU out. they will vote that they have the power to but not push it that far. If they did LSU would file suit in federal court for a multitude of items and would win. prolly would walk away with 500 million plus and Sankeys job.

I think the main plan is to rule us ineligible for the championship game which would likely remove us from playoff contention entirely and give the cfp the plausible deniability to leave us out of the playoffs. So we would have no conference or national championship chances this year.

Then I'm not sure what the further consequences would be next year, but I think that's the plan for this year

ummm....see I do think they will use the CFP to keep us out if they fail and lose the lawsuit, other wise they dont

but this is about them being able to make their own rules and enforce them period.

but as I mentioned before, Sankey fricked up bad on the stand, really bad. especially when not being able to define a professional, not enforcing rules equitable, consistency across the board etc

And you find this all rational?

They'd just be enforcing the rules of a conference some players tried to skirt with a state-based TRO.

If they lay down on this, they risk losing enforceability of any rule to state-based rulings.

Curious, what has your position on Kiffin been since the hiring? Were you a fan of the hire?

Sure. I think that the fanbase got emotional, as you'd expect, and created expectations that are too high. I hope he can fix his big game meltdowns that have plagued him. If he can, then we should win some titles.

Call their bluff. If the SEC wants to watch itself implode and have the Big10 become the one super conference, let one of your premier schools hit the open market. Texas, Bama, etc would be watching very closely to see what LSU gets, and it would be record breaking.

it’s just them showing publically they’re willing to do it.

There is not an actual constitutional right to what they’re asking and this is purely a contractual issue that shouldn’t be in federal court and the court will know that.

We also haven’t done anything against the rules.

I don't think this will end up mattering much in the federal case.

And banning LSU from postseason play even though they were never rostered is the only way to “enforce the rules”? LSU complied, is the penalty you laid out rational?

Agreed. To be expected for sure.

That was more the aim, of my question. Did you think it was a great hire, or did you prefer other candidates in the lead up and were you more skeptical given those flaws in his approach and the baggage he brings, which are reasonable, imo.

thanks

and look in the end im not sure this even ends up being heard in federal court because

1) the judge is going to say.....ok if they are doing what you say and its trampling the conferences first amendment right...what would you like me to adjudicate? only thing the judge could do would be to overrule the lower court and they dont like to do that but now that they are not rostered.....they would just say they cant be rostered.

but the SEC would have to prove that their rules are different than the NCAA. because if not....then saying 1 TRO doesnt matter....means all TROs dont matter and that means Ole Miss is in violation of rules.

not to mention lack of consistency, Gregs testimony fricks up a lot too.

in the end....this was stupid for LSU to push this. I said so from the start....but this is an even dumber move by the SEC....this is the dumbest of moves by epic proportions.

You're adding things I never said

Punishment would require rostering the players

or did you prefer other candidates

No. This was a bad year for candidates and Kiffin was clearly the best.

It's more about ruling the SEC DOES have the power to punish, not necessarily to prevent schools from engaging in the behavior that would be punished (which is the state court ruling)

let me explain why

SEC says this violates our first admin right

judge says ok...cool, what would you like me to adjudicate to make sure this doesnt happen...

sec has zero answer. if its not about the players they have zero. if they say its about the players, you are
1) saying LSU cant roster the players...which they didnt
2) you open yourself up to examine the rules on what a professional is and that brings in the testimony, brings in ncaa rules,
3) you open yourself up for not being consistent across the board with when you enforced the rules

if the sec answers we want the ability to be able to punish members if they violate our rules....if the judge says ok

then the arguments I just made come into play again

any good lawyer is pretty much going to force it down that path

and thats fine

but as soon as you do that, you open the argument to look at the rules which are not consistent.

then it brings in Sankeys testimony

then it brings in consistency of the enforcement of those rules which brings in....do TROs matter or do they not.

That's for the members to address internally. That's why they have that process in place. This wouldn't be addressed by the court in Bama.

they would
likely turn their nose up at our academics, but we really haven’t seen a school our level make a conference say “they don’t meet our academic standards”

That's always been a big deal and a dealbreaker for a school like LSU

And that was BEFORE LSU started this fight. The Big10 doesn't want to deal with us

disagree because of them specifically naming LSU and Kiffin.

can you explain why you feel this away? I know you are a lawyer but you mainly deal with criminal, I know im an engineer but I see these types of things a lot in the corporate world.
