I certainly would not have responded as Barton responded. A simple request to Wade's attorney that all further communications to LSU should be forwarded to me (if I am Barton) only would have sufficed. Wade's attorney would have gotten the message without the unnecessary attitude.

Ok, you aren't defending his tone, but simply his request. I should hope someone representing LSU, particularly during this delicate situation, might employ more tactful language. Barton might be better suited for insurance claim defense.

To all those that contend this was unethical could you refer me to any Louisiana bar sanction that came from communication such as this which was a notification and not a discussion of the matter at hand nor an invitation to discuss the matter at hand.

You won't find one.

Anyone who knows Bob Barton personally or who has been adversarial to his client will tell you he is the epitome of a “professional”. He will not raise his voice , curse or commit actions that are even considered borderline. No issue with him calling Wade’s attorney out for communicating directly with LSU Admin. There is an established protocol that has to be followed and it’s there for a reason.


The issue is the decision to include the NCAA in the interrogation. Garrity would protect Wade from having a statement given to his employer under the threat of termination from being used against him in a criminal proceeding. It would not protect him , however, if a third party like the NCAA is involved and present. LSU should order the interrogation without the NCAA as part of complying with his employment contract, Wade should comply and then LSU can advise the NCAA of its findings. This is the appropriate protocol for internal investigations that involve potential criminal issues.

If the NCAA tells LSU they cannot meet with Coach Wade regarding this issue without the NCA present.

Do you know anything about how that would work
