They broke into a locked room and probably intimidated the person who was there at the time. I do understand the frustration of knowing your stuff is there but until you prove it is yours, taking it from someone else is still stealing. I suspect all the charges will end up being misdemeanors. Also note, the guy with the stolen stuff was not the thief but had bought the items from the guy that Jennings identified as being the thief.

Jennings hasn't identified anyone as being the thief.
It was an unknown person reported to have broken into his apartment and stolen his stuff.

the other guy is being charged with possession of stolen items. Go figure. And assuming that the items are worth more than $500, that dude actually committed the more serious crime and could do up to 5 years.

Either way he's going to be in trouble. He is still supposed to report that he thinks the items in his possession were stolen.
