I agree the neighbor should pay. Any reasonable, respectable person with the ability to would. Maybe they are not a dick (as you call them) and instead are under financial hardship, and $1,000 would crush them.
Completely ignoring that and screwing your neighbor with a lawsuit is the dick move. I’d feel like the terrible neighbor if I did that.

That's a fair point. Sounds like a perfect opportunity to propose a dowry type of reimbursement. OP pays the damages and in return, the neighbor sends his wife over on weekends for three weeks.

I'd explain to the neighbor that you'll report it to your homeowners insurance company and let them handle it. That way, when they inevitably come after your neighbor through subrogation, you're not the bad guy.
The OPs insurance will deny the claim for loss less than deductible & there will be no subrogation.

all I can say is that must have been a heck of a collision for the 6-7 y/o. did the kid sustain any damage? I backed into my door and it didn't do that much damage.

A combination of a sloped driveway and the kid not knowing how to brake properly led to him building up a lot of speed prior to collision. No idea how fast he was going, but it wasn't pretty at all. The kid is a tough little bastard though. He was out riding around the next day and didn't have any noticeable scratches.

You could get another estimate and, if it is still at a grand, you may ask them to pay half now and then rest in a few months. I’d do that first before anything else to recover the cost.

Just ask them to pay what they can

You should post the video

They’re responsible for it and should fix it. But if they balk at the price, you could sue. I don’t know that I’d sue or file a liability claim against them myself for a number that low, but that’s always an option.
Other option would be to ask them to find someone to get a quote for the repair if they think yours is too high.

How close do they live? Next door or three streets over?

This is liability, baw.
Correct, there is no deductible on a liability claim. Only the inevitable rate increase you get smacked with...

quote:Then you’re out a deductible, which would probably be higher than the $1000 damage anyway. You’ll end up paying out of pocket and your insurance has no reason to subrogate (seek reimbursement from responsible party or their insurance) since your insurer wouldn’t be out of pocket for a claim that was below your deductible anyway.
turn it over to my insurance company and let them handle the rest.
Tell the neighbor they can either pay the damages, provide you with their homeowners insurance info so you can start a liability claim against their policy (which wouldn’t have a deductible), or you can take it to small claims court where they can end up losing court costs on top of the $1000 considering you have video evidence.

quote:Which is why if it was my kid who caused the damage, I’d pay the repairs out of pocket. But if OP’s neighbor wants to refuse to pay, then OP should make a liability claim against their insurance. The rate increase and any other insurance problems would be on the neighbor and he’ll learn the hard way that he should have done the right thing and offered to cover the repair cost.

I like the idea of letting him work it off. Maybe they can't afford it.
What sort of home do they have? Cars? If they have a new Range Rover in the driveway I'd feel differently than a 15 year old minivan.
