Soooo, nothing really changes here.

Tokens may be stupid, but did you really put a bill forward to buy beer straight with cash instead of a token first, and still not be able to walk out of the brewery with it???

Not being able to buy bottles for off premise consumption really holds back alot of breweries.

Rather than having a "tour" once a week, they can set up legit tap rooms

Like I said, it's not perfect but it is moving forward. I imagine limiting the purchases to on-site only is one of the compromises that was made

So will this have any affect on 8th Wonder that just opened in Houston? I had some of it last week at Liberty Station.

A very bad one.

From a consumer's point of view, I'd rather the ability to buy straight from the brewery than what was won with these bills.

Freetail is a brewpub (and a very good one) so it's nothing but beneficial for him. And Saint Arnold is too big to bother with self-distribution so they stand to lose nothing either.

If they really did change it to still allow self-distributing then it's probably a win all around. I don't think it originally read that way, though.

Probably not, but it depends on the self-distribution rules. I've seen mixed things.

I know at the moment they were just hand delivering kegs to bars in a fairly limited area (basically around downtown since that's where the brewery is).

That's how most of them start out... self-distributing the beer to places nearby.

I really don't know the whole of it, but it sounded like small breweries were getting screwed. Maybe not, though.

Here's what changes, what used to be a $7 tour with 4 'free' beers of about 8oz each now becomes a free tour with the ability to purchase beverages at retail prices in the tap room.
Brock Wagner was on the Michael Berry show last week and made a statement that he's been 'giving away' beer on the tours for years and this bill now allows him to charge for those beers.
This isn't about making a better beer scene, it's about making more money for the breweries that have arrived. If it only helped the small breweries nobody with any weight would've ever got behind it. Now we're left with an even more stratified system and the small guy doesn't have as many allies as before.
I think This is why Deep Ellum and Buffalo Bayou are pissed, it's not as much of a community as they might've though... business is business.

After reading through some more articles on this, that's pretty much what I've taken from it.

The biggest positive from this appears to be that changes were actually made where there's been little change in the past. This is great if it leads to more changes to help the little guys as well...I'm not holding my breath though.

I'd like to think that we'll continue to pass bills and laws that allow small business owners the same rights as everyone else but the cynic in me can't believe it.
The M Berry show I mentioned was focused on how liberal states such as California and Oregon have friendlier laws to small business owners (in this case breweries and brew pubs) than Texas and how we should be totally outraged by it.
It didn't sound like Brock was on board with that message and made it clear that he was only supportive of bills that were designed to help his business out, regardless of how they affected others (including the startups that are now where he once was).
That's what we have now and I think that's why we're seeing some of the backlash to these supposedly ground breaking measures.

I wouldn't be surprised to see a law suit in the near future. Craft Beer brewers can point to Texas laws on wineries and ask "why is beer being treated differently?".

net-net at the end of hte day this is forward progress. if you understand how politics work this is a good thing. it opens the door for incremental changes in the future to brew laws as the industry continues to develop.

There are plenty of groups who will continue to lobby and work with politicians on beer laws going forward. this is a crack of light in the previously blackened tunnel.

Is it what all of us would like in ideal world? no, but its a first step.

i agree

I know we would like to see the three tier system get a major overhaul, but it's just not going to happen in Texas anytime soon, if ever. There is far too much money involved and too big of a lobby to overcome

At least in TX they can self-distribute... can't even do that in LA.

Nope, same sort of tour/token system as they have in TX currently.

Although there is talk about a loophole where they might be able to serve on premise in the future. Parish is brewing a taproom in anticipation, but they also just use it for the tours & merchandise sales currently.
