CA Bill Would Force Stores to Display Children’s Items in ‘Gender-Neutral Area

California legislators are considering a bill that would require retailers to display children’s clothing, toys and other child-related items in a “gender-neutral area,” regardless of whether the items have traditionally been marketed for either girls or boys.

AB 1084 would add a section titled “Gender Neutral Retail Departments” to the state’s civil rights law, and would prohibit retail department stores with 500 or more employees from using signage within the undivided gender-neutral area to distinguish between girls and boys products.

“Assembly Bill 1084 does nothing to advance civil rights—and a lot to undermine the ability of retail stores to manage their own businesses,” California Family Council (CFC), a state affiliate of Focus on the Family, argues.

The bill would even extend to California-based stores that sell products online, forcing them to include pages on their websites offering the products in a collective “kids,” “unisex,” or “gender-neutral” format.

“This is an issue of children being able to express themselves without bias,” California assembly member Evan Low, who introduced the bill, contended.

Low has previously said that the inspiration for the bill came from the 9-year-old daughter of one of his staffers. The child told him that she didn’t like how boy and girl sections were separated and that he should make a law against it.

“Keeping similar items that are traditionally marketed either for girls or for boys separated makes it more difficult for the consumer to compare the products and incorrectly implies that their use by one gender is inappropriate,” the bill reads.

If passed, AB 1084 would go into effect on Jan. 1, 2024. According to the text of the bill, retail department stores that fail to comply with the law will receive a written notice from the attorney general and be given 30 days to correct the violation. But if a store continues to violate the law, it would be “liable for a civil penalty of $1,000.”

“California doesn’t need additional laws that micromanage and punish businesses,” CFC says. “This self-proclaimed civil rights bill actually cheapens the noble intent of the [civil rights] law. It’s one thing to forbid companies from discriminating against people, but quite another to tell them how to market and merchandise sale items with the goal of changing public perceptions of gender roles.”

Seriously, who does this help?

Are there children out there that are traumatized by the toy section? I've never seen a kid look offended in a toy section.

The law is a huge waste of time.

Especially considering most sites will probably just take down a sign.

It’s not like Dolls won’t have their own section and girls won’t gravitate to dolls.

Is that even legal? I really don't know but I find it hard to believe the government can dictate how a store arranges their product.

What if I just happen to select blue and pink colored shelving?

Are they going to regulate that?

FFS - toys aren't even really separated by "boys" and "girls" except in the practical sense that Barbie shite is together, trucks are together, Supersoaker/Nerf Guns are together, dolls, etc.

Imagine waking up being angry about things like this.

All kidding aside...what percentage of the American public are we even pretending identifies as something other than male or female?

It's bad enough when 13% of the American public seems to drive almost EVERY topic is modern politics, but given this number has to be fricking miniscule, it's hard to fathom why we're expected to cater to such a tiny fraction of the public and essentially re-do our entire society to make them less angry.

I'd have said happy, but let's be honest...no one on the left is ever fricking happy.

Exactly.

I've never seen a boys or girls sign in the toy section.

I've seen an aisle for dolls or stuffed animals or Legos or board games. But never anything saying "this is for boys" or "this is for girls".

I’ll tell you what, they could have mixed all the clothes together when I was A kid and I still would have worn exactly what my mom bought for my older brother 4 years before.

The retailer I work for is already doing this very rapidly over the last year or so. Apparently "gender neutral" clothing is the fastest growing segment of kids clothing in the country.

What it looks like in practice is that approximately 25% of the Boys and Men's sections are merchandise with clothing for Girls and Women. Shirts are thinner, shorter, and reflect culturally feminine themes. Joggers and sweatpants are thinner and cheaper.

The jist is that "gender neutral" basically refers to women, especially younger women, wanting to wear bigger, more boyish clothing, and apparel companies just rebranding their existing men's space rather than overhaul their women's assortment.

I hope it passes and stores like Old Navy and whatnot say screw it and make public plans to close stores before the law takes effect.

It'll be a nice slap to the face of the CA legislators who keep making idiotic laws.
